cr-1 advice

hello all!

my partner and i having some trouble figuring out if we should get married in peru, go with a k3 or cr1 visa, or go with a fiance k1 visa and get married in the states. we want to live there, as i plan on going back to school.

not to be a bother, but i was hoping to get some advice on why you chose to do cr1 and how it's going?

Timeline

Howdy. Welcome to VJ. We chose the CR-1 for the following reasons:

1) no guarentee that K3 will be approved reasonably quicker than the CR-1

2) Cheaper

3) Can work and travel immediatly

4) no need to sit at home waiting to adjust status from K3

5) Did I mention cheaper :)

Citizenship

April 29, 2013 - NOA1 for petition received

September 10, 2013 Interview - decision could not be made.

April 15, 2014 APPROVED. Wait for oath ceremony

Waited...

September 29, 2015 - sent letter to senator.

October 16, 2015 - US Citizen

We chose that because a) you get to go the the US with an immigrant visa, and B) it is a lot cheaper in the long run :)

12-09-08 - INTERVIEW @ 6:30AM...God be with us! --- APPROVED!!!

12-11-08 - VISAS RECEIVED....YAHOOOOO!!!

04-07-09 - POE: Chicago O'hare

04-28-09 - received SSN's (after having to apply for them personally!!!!)

04-30-09 - Received our 2-year GREEN CARDS

01-07-09 - ROC, here we come!!!

01-18-11 - Mailed out I-751

Live Where? USA or Peru?

If Peru, why not marry in Peru and study, if you are in Peru for 6 months of longer you could file the I-130 for a CR-1 directly to the US consulate, this is MUCH faster than the other options.

In any case the CR-1 is the best option, it takes about the same time to get, it costs much less than a K-Visa when you consider Adjustment of status. CR-1 gets a green-card upon entry to the USA allowing work and travel. K-Visas needs EAD inoder to work, EAD can take 90 days or longer to get.

currently i (the us citizen) am in peru. we both are. 6 months in peru is the requirment for filing the i-130 and cr-1 dcf? i don't think peru does dcf anymore...i don't find anything on the website.

i've read the doing the cr-1 is easier if the us citizen petitions from the states. will being here in peru complicate all that if dcf isn't an option?

It is quicker to DCF. Only complication with DCF is US Citizen needs to show that they maintained US Domicile, that is demonstrate that residence in foreign country was temporary. Domicile is required for the I-864, and Petitioner must provide an I-864.

Timeline

The main reason for doing CR-1 is that you will have your work authorization when you arrive in the US. If you file K-3, then you will have to apply for work authorization once you get here.
