To remove conditions, I think you must do so jointly (meaning that you are still with your husband -- living as husband and wife) or do so alone if your husband died, you are divorced, you were battered or terminating your status would cause hardship.

Hopefully others can provide more insight... :-)

Hello friends

My k3 visa has been approved and issued (confirmed by Department of states) but the embassy needed my new medical and police report(as the previous one has already expired) which i sent them today..So as as soon as the embassy review these reports they will send me the passport....On the other hand my I-130 case has been approved by the USCIS and they have sent an approval notice to my wife about it....So i just wanted to ask that while waiting for the passport to be sent by embassy.... Can my wife or me file for AOS and EAD?..or is it must for me to be in US before me or my wife file for me the AOS file?....i just want to save time on this as my k3 visa has been stamped according to DOS information and the I-130 is also approved already...Your valuable suggestions are

needed....take care

with best regards,

prayers

For a K-3, physical entry needs to have occured BEFORE AOS/EAD can be submitted!!!!!

The USCIS does not issue greencard to anyone who has NEVER stepped inside the USA

YMMV
