When I filed the K-1 visa I wrote on the "how we met" section, and also the part where you're supposed to explain you're intents to marry, that we would probably live in the US for about 2 years and then go back to Guatemala. Now we are leaning more towards staying in the US and either way we will have to apply for his Green Card. My question is will this hurt us in the interview process if they think he will not be staying? Or even before the interview when they are going to approve the application here?

06.09.09 - sent AOS,EAD,AP packet

06.17.09 - NOAs issued

06.24.09 - Biometrics done (3 weeks earlier than appt date)

07.03.09 - received RFE for I-693 (dated 6.29, responded 7.07)

07.23.09 - transferred to CSC (received letter 7.27)

07.29.09 - EAD Card Production Ordered & AP Approved

11.23.09 - AOS touched - card production ordered & welcome letter sent - 13 months exactly after initially applying for K-1!

12.03.09 - GC arrived in mail

Removal of Conditions Process

07.28.11 - received reminder letter from USCIS to remove conditions before 11.18.11

09.28.11 - mailed I-751 packet

10.03.11 - NOA

10.05.11 - check cashed

11.25.11 - Biometrics

07.24.12 - GC approved!

08.01.12 - GC arrived in mail

Citizenship Process

12.16.16 - sent N400 packet

12.23.16 - NOA issued

01.27.17 - Biometrics done

02.01.17 - put in line for interview

03.15.17 - scheduled for an interview on 04.21.17, had to write a letter asking for a reschedule because we will be out of the country

03.31.17 - scheduled for an interview again

05.09.17 - Interview!

It should not hurt you.

In the future, make sure you just answer the question posed, and don't give any more information than needed.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I disagree. It could hurt you severely unless you provide a notarized letter explaining how your plans have changed. The K1 path is intended for those who plan to become US permanent residents. It is not designed for the purpose you described in your petition. So, whether it hurts or not will depend on how good a job you do in your letter and she does in her interview, explaining how your plans have changed so that, you now intend for her to reside in the US as a permanent resident.

Where do I mail such a letter? Or should I call? Or would it be best just to leave it and wait for them to challenge it??? Really, as long as our intentions are truly to marry then we are using the K-1 visa correctly, and even for him to stay here 2 years we would have to apply for permanent residency, right? Technically we still haven't decided 100% one way or the other because there are so many "what ifs" involved.

You may want to call the customer service to inquire about where to send your update. I wouldn't just wait for them to challenge it as that may make for a longer process... The question was just 'When and how did you meet?' correct? You should make sure that you don't try giving more information than asked for in the future because it may cause concerns such as this :/ You may want to mail or even call in a change to amend your statement about moving back to Guatemala ASAP if you think it will make or break your case :)

I wouldn't mail the letter to anybody but your fiance(e). Let them carry it to the interview and hand it over if the question comes up.
