Consulate returned I-129F back to USCIS

Timeline

My fiancee's visa was approved by the USCIS, which was initially submitted early March 08. They sent it to the US Consulate in New Delhi. They took about a month before sending her the letter to schedule an appointment, then that took about 2 more weeks. She was initially denied at the interview due to 221g - they didn't think we had enough evidence of engagement. So she submitted more stuff they requested, and they sat on it for over 2 months.

The 4 months window expired. They sent it back.

Its been 2 weeks and the USCIS still has no record of this. My online case status has not changed, and I have not received any letter on my end.

What am I supposed to do now. :(

Did you maintain constant contact with the Embassy after the new information was submitted?

It is not a good thing to have a file returned.... The USCIS current process seems to be to do nothing with returned files. Simply to sit on them and let them go stale and close them.

It can take months to get back from a consualte and then they have 4 months or more to even have to reply by.

First visit:2007-09-12 to 2008-09-23

I-129F Sent : 2007-11-24

I-129F NOA1 : 2007-11-30

I-129F NOA2 : 2008-03-31

NVC Received : 2008-04-21

NVC Left : 2008-04-23

Consulate Received : 2008-04-28

Packet 3 Received : 2008-05-20

Interivew date : 2008-08-07 CO asks inappropraite questions

His father died: 2008-08-18

Retain Marc Ellis 2008-09

Visited Nigeria again: 2008-11-12

petitioned returned to CSC :2008-11-27

returned to USA 2008-12-13

His father buried 2009-01-03

picks up K1 visa Nov 2009

Marriage Dec 2009

take throne as Igwe /Lolo 2010 or 2011

It is not a good thing to have a file returned.... The USCIS current process seems to be to do nothing with returned files. Simply to sit on them and let them go stale and close them.

Yes, I emailed both the Consulate and VFS every few weeks and ensured I got a reply about the status. I found out about the 221g status even before the letter was sent. She tried calling from her end but that was a waste of time.

Hello,i feel sorry for you ,honestly it is the worst feeling that the man might have ,i had it and i have been waiting about a year and nothing heard other than receiving our petition by USCIS and they were reveiwing it......

My K3 petition was returned back to USCIS on Jan,22nd,2008 and i am still waiting till this moment to hear from the USCIS

You guys are basically screwed. Time for plan 2. From what I've seen once the petition is returned to USCIS it's basically history. Happen to me. Think about marriage and a CR-1 visa. You must realize India is a high fraud country and you have a uphill climb even with a spouse visa.

What did the the 221g say?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

They thought there was a lack of evidence of engagement.

If you are going to continue you guys should start accumalating more evidence of a bonafide relationship. Multiple trips with LOTS of pictures are probably the best proofs.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

If you are going to continue you guys should start accumalating more evidence of a bonafide relationship. Multiple trips with LOTS of pictures are probably the best proofs.

We have all that. I have an office in Mumbai and was going every few months. She came over and stayed with me in an apartment for a few months. We took a trip to Goa together. We took a trip to Bangkok together. We kept all the plane ticket stubs. We have cards and email and chat logs and phone records, etc. We have lots of pictures.

The interviewer's biggest question - why didn't we have a big engagement party? Because my family doesn't live in US. Because her father is deceased. Because we're both divorcees, and Christian, and don't care to throw such a big party. We gave him the extra evidence he wanted, and they didn't even look at it. They sat on it.

I would say its time to contact your elected representative. This is the first time I have heard an embassy sending back an petition that was in progress. Other embassies just extend the expiration date.

this has to be a joke! :angry: cause u didnt have an engagement party??? I didnt either...i dont know anyone in my circle who has! wat on earth? i'm so sorry! that is ridiculous! i'm so sorry for your ordeal! :(

Something is not right. The embassy can and usually extends the 4 month limit. It is very common. Also one does not have to have a huge engagement party. Just stating to each other that you both want to marry means you are engaged. Has to be more to this.

If its more, then they didn't tell us what it was. I'm wondering if it has to do with the new presidential election.
