Hi VJers just had my interview this morning.. Everything went well ( as I know lol ) I got PINK SLIP but :oops: not so good..it comes with a WHITE SLIP! :protest: White slip saying that i need to secure a Letter of Consent to Immigrate from Derivative (my daughter's) Biological Father. :bonk: Now my problem is where to find that grrrrr biodad and incase i found him.. what should he need to do or write in the consent? What if he don't want to give me? What will I do? Last thing i heard about him is through our common friend that he is already living in the US (petitioned by his mom). Any advice regarding this will be highly appreciated.. I feel so bad and kinda frustrated -_-:(:crying:

Why don't you try to get a lawyer to prepare the affidavit stating that your daughter's father is nowhere to be found and the affidavit must be duly notarized... And also, if you could find any relative of this guy and let him/her make an affidavit saying that the father is not in the Philippines and/or they don't know where he resides now...

Are your daughter present during the interview, or follow to join?

Was your child using her father's name? I executed an affidavit of illegitimacy explaining that my daughter has been with me since birth and that i had no ties with her father and that she does not carry his name since he did not acknowledge being her father in her birth certificate. His name does not appear in her birth certificate either.

12-09-08 - INTERVIEW @ 6:30AM...God be with us! --- APPROVED!!!

12-11-08 - VISAS RECEIVED....YAHOOOOO!!!

04-07-09 - POE: Chicago O'hare

04-28-09 - received SSN's (after having to apply for them personally!!!!)

04-30-09 - Received our 2-year GREEN CARDS

01-07-09 - ROC, here we come!!!

01-18-11 - Mailed out I-751

I assume you're not married to your kids biological father?YES?I too have most likely situation as you do.I have 2 kids,eldest got my last name but my youngest is from his father,both of my kids has the same father but we never married or anything.I was very concerned about that before our interview-so in order to get things ready,we made an Affidavit of Support notarized by a lawyer,and witnesses that i was never married to their father and we stated the reason why my 2 kids has 2 different last names and i raised them alone.So i got all that documents ready with me on the day of the interview incase it's ask.The CO asked me about it,and made an explanation why,and i believed she was satisfied with my answere since she didn't ask for any Supporting documents regarding my statement or whatsoever which is a huge relief.

What i write above might not be an advice but maybe a clue or idea.My question is,Were you married to their father and annuled?Or not married at all but kid got her father's name?

No.. the biodad and i never get married at all. And my daughter is carrying my family name.. it's just happened that he signed the acknowledgement of paternity. So the CO asked me to send the "letter of consent to immigrate from derivative biodad" for our daughter. As I can see it, the CO just dont want to get us in trouble in time when the biodad will find out that i brought her daughter without his consent and since he was signed in the BC, he has the right to sue me for that. And to make things more complicated.. i just found out from his brother ( good thing they are still alive lol ) that the biodad is now residing in New Jersey as petitioned by his mom and now a greencard holder (Legal Permanent Resident) and i was like WOW! (Actually i know about that petition eversince and that's one of the reasons why we didnt get married before (GOOD THING!) but in time we broke up i never hear anything from him nor from his family at all, our daughter never see or meet him in person.. only in picture) Good thing his brother gave me his contact number in the US but been trying to call him and still no one is answering! grrrrr but im sure as soon as i talked to him he is willing to send me the consent..he should be!!!! He runined my life and im sure he doesnt want to ruin his daughter's future too. Not again! But if he wont cooperate.. i guess nothing i can do but to file an abandonment or any opinion from you guys that i can do about my case? any help or suggestions will be highly appreciated. thanks. :)

If he does cooperate which i think he will,hopefully, then i dont see any reason CO wont grant you and ur daughter a visa.How old is your daughter?If he doesn't cooperate then file for abondonment,which you'll be working with a lawyer and you'll beed witnesses that he tottally abondond his kid and you guys never heard anything from him,no support at all and you have no idea his whereabouts.We worked with a very good agency in Cebu where they made us a really good and stated documents and fortunately,Co didn't ask any supporting docs regarding my childrens ligetimacy.

Oh,we had an agency from Nevada whom we thought will help us all the way(but they did not).They suggest us to get my kids father's consent letter which i refused,Why would i?he certainly abonded my kids.Not fair huh?you raised your kid and now the good future of your daughter is being sacrificed because of someones irresponsibility.he's current residency is i dont think a threat..Goodluck

Finally i get to talked to the biodad and he is willing to cooperate and will send the letter of consent as soon as possible.. and it is confirmed that the petition of his mom for him gets approved and now he's living there as Legal Permanent Resident as status for 2 1/2 years now. And now.. i hope when i get to submit the consent i hope CO wont ask anything again when she gets to find out that the biodad is in the US too, that's the only thing im afraid of. I am thinking the other side of it.. what if i'll just file an abandonment? I really don't know what's the right thing to do. But i've talked to a lawyer and she advised me that it's better to send the consent since i get to find the biodad and willing to cooperate and forget the crazy thinking about his status in the US. Nothing else we can do but to tell the truth and if CO asked for something then so be it need to comply with it and go through the process and wait. Well i guess that's it.. I just hope the consent will be enough. And i trust the Lord, I know He's beside me always. :)

You are welcome.Glad to know he's willing to cooperate for the sake of your daughter which he should really do.I'm quite sure the Co will ask you where is the father of ur daughter and you better tell the truthCo only asked for that document so,i think you're all set now.Keep hoping and praying,it's the only way to make things right.I trully feel your worries coz i felt the same way during our embassy time with my 2 children. :innocent:
