do you know the cases in which the visa was rejected? is it often debying the cases or its rare?

Meeting Online: Yahoo chartroom Aug 2001.

Direct meeting & marriage: Dec 2003 USA, NY

I-130 petition in DCFR Tokyo: March 14th 2004. Case reffered to DHS USCIS

Four visits to japan in 2004: Oct 2004, wife got pragnant.

Wife/Fiance left USA and moved into Japan: Feb 5th 2005.

Baby Born: June 24th 2005(Japan)

I-130 denied: July 17 2005(Divorce was declared not valid)

Refiling Divorce: oJuly 17th 2005 NY State.

Divorce granted: Nov 17th 2005

K-1 application: Mar 1st 2006

Approval: May 23rd 2006

US consulate RFE: June 15th 2006

FRE sent (Original passports, birth certificate, all origional docs): July 10th 2006

Medical: Oct 11th 2006.

Interview: Nov 10th 2006(expected)

Its neither rare nor often - it just happens.

It can happen for many reasons - if the Consulate officer isn't satisfied with something they MAY 'deny' a visa but many times they will allow rectification (say, for example, they weren't convinced the relationship was genuine due to lack of evidence, but you are allowed to provide more info). Sometimes they will not allow this. It depends entirely on the individual case and the adjudicating Officer.

Some visas are denied outright for things like criminal history - like drug convictions (any convicted crime of Moral turpitude, as defined by the regulations, can result in visa denial).

Applied for K1

Met online 2001 - just aquaintances

Sept 2002 - 1st US visit - everything goes perfectly.

Dec 20th - Forms recev'd at CSC

Dec 27th - NOA1 received by snail mail!

Dec 29th - 'Touched'

March 10 2006 - NOA2!

March 23 - recv'd at NVC

March 24 - petition sent to London

April 9th - Pkt 3 rec'd!

May 17th - Pkt 3 signed for at London Embassy

May 24th - Medical

May24th - Pkt 4

June 14th - Interview 10am - APPROVED 1pm!!

June 16th - Visas received in my hot little hands 1pm :)

July 19th - flying to US!

July 27th - Married!! :-)

Aug 7th - Applied for SSN in married name

Aug 9th - SSN received

I will assume you are talking here about cases where there is an approved petition, the alien is an admissable alien (no criminal background or health issues) but the consulate suspects the relationship is not bonafide, and refuses to issue the visa.

In some countries it happens more (or even much more) often than in others. USCIS seems to apply the same rules to all applicants, but the consulates do not. If you read threads from different places, you'll see that in some countries (Nigeria and Vietnam come to mind) applicants sometimes have a more difficult time convincing consular officers of the bonafides of their relationships, while in others (countries where no visa is needed just to visit the US) there usually are few if any questions about it at all.

There are always exceptions to the rule, but what passes for enough evidence of bonafide relationship in some parts of the world isn't enough in others. I would like to remind those who have not interviewed yet to keep this in mind.

I'm really sorry you're having trouble gugu. I know how heartbreaking it is to go through that when you really really are for real.
