K1 and divorce

can i file my fiance petition now that i have the final judgement of the divorce?effectivity is 2-2-2009,

i believe i cannot marry my fiance until after 2-3-2009,,but can i file the petition around january?im going to visit my fiance this january so i want to file before i leave..please help.thanks.

Same question asked just a few minutes ago probably by the US Citizen who will be filing the I-129F

You are not FREE to marry until Feb 03 2009, so CANNOT file I-129F until then.

You and your fiancé(e) intend to marry within 90 days of your fiancé(e) entering the United States, and are both free to marry, and have met in person within two years before your filing of this petition unless:

Yes, so long as the "Post mark" after Feb,3,2009, the petition gets sent to service center having jurisdiction over US citizen's place of residence in the USA.
