divorce effectivity

hello guys,,im new in this site.i have a question,i hope you can help me,i had a divorce and the effectivity of the termination of marriage is february of 2009. i have the certified divorce decree signed by the judge,can i file the petition now for my fiance??

it says here:

date marital or domestic status ends:2-02-09

warning:neither party may remarry or enter into a new domestic partnership until the effective date of the termination of marital or domestic partnership status.

is it ok to file now?

You are not FREE to marry until Feb 03 2009, so CANNOT file I-129F until then.

You and your fiancé(e) intend to marry within 90 days of your fiancé(e) entering the United States, and are both free to marry, and have met in person within two years before your filing of this petition unless:

YuandDan is RIGHT!!! Because you are LEGALLY bound to your previous marriage, you are currently unable to enter into a new marriage. I know because I went through the SAME thing. California has some funny laws and this is one of them.
