Here is a superdificult situation

My sister in law lives with a guy from Jamaica.

He came here 10 years ago to study.

After a while, he made an agreement with a us citizen girl to get married so he can file for adjustment as married to a us citizen.

They got married in 2004, and in 2005 he got his temporary GC.

In 2006 he met my husband's sister and they started living together.

They now have a doughter together, but he never got divorced from that other girl.

Meanwhile, he applied for the citizenship. By preparing him for the interview, his lawyer advised him to tell the whole truth, to admit that the marriage thing wasn't genuine and everything was to get the legal presence in the US. Eventhough, his legal wife is willing to help now, there's nothing to be changed, cause he did tell all the truth.

So, now, obviously he recieved a letter stating that he's now officialy a subject for deportation, and he cannot continue to work or do anything.

My sister in law is desperate. They have a little girl together and he is actiolly a good family-man.

My question is if he divorces that girl within the next 30 days and get married to my sister in law, and they make the paternity test to proove that they have a child together and proove they have been living together for 2 years, can that help, or he's definatelly going to be deported?

oh lord

well he committed immigration fraud, so there really is no way (that I can see) that he can adjust status.

and even if there was he lied once, it's not entirely possible they'd believe him even if he had a child.

but why on EARTH would he take that awful advice and admit to committing fraud? how would that have possibly helped his case for citizenship?

Wow. I don't think there will be much he can do, after admitting to blatant visa fraud. Not cool. Get an attorney.

the thing is an attorney screw up the whole story to begin with :wacko:

Well lawyers aren't infallible. But some are downright stupid (like anybody else really).

That was really REALLY awful advice he got.

No. The thing is your brother in law committed fraud and screwed himself up. Don't put his initial dishonesty as the lawyer's fault. He needs to own up to the ####### he pulled. No sympathy at all.

He should have divorced, then applied for US citizenship. I really don't know if there is anything he can do now. There is one thing, beat the ####### out of that dumb lawyer that put him in this mess.

I am far from being sarcastic, and assure you I am very serious. Outrage towards the lawyer is misguided and will do nothing to help this situation.
