Hi there

I just thought of an idea. I am waiting for receipt of I-130 so that I can file I-129F for my hubby. But since recipt is taking a long time (8-10 weeks). Would it make sense if I send papers of I-129F get NOA1 and the reciept date and let them issue an RFE and then submit I-130 receipt notice.....This way, my dates for I-129F will be set ..Thoughts ?

I would have to say wait b/c teh receipt from teh I130 is required for the I129F. You need to have a pending I130 in order to get and I129f off so wait youshould be getting a reply soon.

I do not wish to share any information about this dead end journey.........I have reached my final destination on this train, and it is time for me to get off.

I don't know if your date for the I-129F will be "set" if you submit an incomplete application.

Wouldn't it be like submitting your application without the payment? Or like submitting your I-130 without all the documents needed. :blush:

No, definitely wait for your NOA-1 from the I-130 before filing the I-129F. You could end up with a huge headache.

The i-130 is the basis for your I-129. Even if they issued an RFE for the I-130, if you responded with a NOA from the I-130 that postdates the I-129 application, the I-129 application would be denied because you submitted it before meeting the basis requirement.

I think it is more likely they will deny it without an RFE.

Not a good idea at all. Please wait for the I-130 NOA-1, then go with I-129F.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Two thoughts.

- Without satisfactory evidence that an I-130 has been submitted you are more likely to get the I-129f back with a Refusal Notice than to get a Receipt Notice followed by an RFE.

- The I-129f for a spouse requires evidence that I-130 was submitted. It does not specifically require that the Receipt Notice must be that evidence. Do you have a photocopy of your signed and dated I-130 petition? And a receipt for shipping it? (The USPS 'Track and Confirm' service would have been good for this, since it shows when and where the mailpiece was delivered.) This may be good enough evidence to get your I-129f accepted for processing, and may even be good enough evidence that you don't get an RFE for the I-130 Receipt Notice.

Let us know what you do and how it works out.

you all are right ..I am just getting restless. i have waited a long time. I got enagged to this man last June and still no end is in sight :-(

It is also true that do not ask for I-130 receipt but just eveidence. Not sur what to do I am confused. I guess I will wait for one more week and revisit this :-(

Follow the rules, I say, or you could jeopardize the process, making it take longer. Few people realize going in that there will be so much paperwork, angst, and seperation. Inventing your own shortcuts isn't a good strategy. Inventing ways to pass the time, being with people who are supportive, and working toward your inevitable life together are better ideas, I believe. Go paint your toe nails red. Enjoy being a newlywed.

Killing my own stupid idea ! Here is the text from USCIS site :

How Do I Apply?

So that the alien spouse and child may apply for a K-3 nonimmigrant visa for a spouse and a K-4 nonimmigrant visa for a child, the citizen must file Form I-130 on behalf of the alien spouse with the applicable Service Center having jurisdiction over the citizen’s place of residence. The citizen petitioner will then receive a Form I-797, Notice of Action, indicating that the I-130 has been received by the USCIS. The citizen should then file a copy of this I-797, along with a Form I-129F on behalf of the alien spouse and any children, to the following address:

U.S. Citizenship and Immigration Services

P.O. Box 7218

Chicago, IL 60680-7218

Petitioners should be careful to follow all instructions on each form and provide the Service with all necessary documentation. Following adjudication of the Form I-129F, the petition will be forwarded to the applicable consulate so that the alien beneficiary or beneficiaries may apply to the Department of State for nonimmigrant K-3/K-4 visas.

Please don't be discouraged. When you look at your timeline, it's full of important accomplishments: getting married, getting your U.S. citizenship. You need to congratulate yourself rather than set artificial deadlines. This month, you took the first step for your husband: the I-130. If you love him, you'll follow through, for yourself as well as him. Compare your process to those in a similar situation to get an idea of the actual time involved. Then relax. Because you've already set the wheels in motion for good events in the coming months.
