EAD? Married! Just got a job!

Timeline

I don't know but I think I am about to make a big misstake...

My K-1 visa expired in late august, but we haven't been able to afford paying for the green card until I got a job - And now I am about to start on monday... I thought that now that I am married it is ok? Or is that wrong?

I just sent in the AOS papers with the EAD today - hoping that I can pay it off with my upcoming paychecks.

Really I am not a K-1 visa holder anymore... just married to a USC

What should I do?

How long did it take for you guys to get your EAD?

Was it correct to send the whole package to the Chicago PO box?

This is a FAQ,

EAD can take up to 90 days to get.

Yes everything gets sent together to Chicago.

I-765 is coded (c )(9 ) based on pending I-485.

All that maters is getting married within the 90 days granted by the I-94, the K-1 visa is VOIDED the moment is is used to enter the USA, it's expiration is not the issued, the expiration of the I-94 is what counts.

Yep, the employer is required to do an I-9 to verify employment eligibility.

K-1 is a fiancee visa not a work visa, your I-94 is expired so you don't have any EAD even a possible "Temp" one that you may had got at the POE.

No, I guess I just figured this out... But I am suppose to start on Monday... I'll have to be honest with them..

I just dying to hear that I can get around this some how, but it doesn't seem like it.. I read that there are extended authorizations... but nothing on how to get it.

My husband just had a surgery and is off work for 6 months - aka - no income.

I am just about to cry.. I can't believe that I missed this!

And I just got the best job ever - with great pay and benefits.. but I can't take it...

I thought Social security wanted to collect tax money as soon as they could?!

When I read stuff on the social security website there are so many different ways.. it is nothing this is right and this is wrong... It makes me frustrated.

Thank you guys anyway..

Sorry you are in this situation, SSA do not deceide who can work it is the USCIS that grant Enployment Authorization, that is why you need to apply for a EAD along with your AOS, you are not authorized to work until that has been approved. all you can do is be honest with your employer and see what happens.

Hey, there might be a solution for your situation, but you need to talk to your prospective employer about it and gain their cooperation.

Explain that you still do not have authorization to work but will have it once your EAD is approved in about 3 months. Explain that it was an honest mistake and that you genuinely believed you are authorized to work on the K1. Suggest the following to them: you will volunteer with them for no pay, until you get your EAD. When you get the EAD, they will then officially employ you (starting date on your work contract should be after you get the EAD) and they will offer you a signing bonus, mutually agreed to be equal to the pay for the time you put in before getting the EAD.

I admit I don't know what the tax implications would be for the employer for such an arrangement, and if it will suit them or not, but tell them that you really want to work for them and are willing to offer them your time for free until you get the EAD as an investment on your part in their trust for you.

Unfortunately this does not solve you cash problem, but you really seem to like that job and might be worth a try.

Again, I might be mistaken, and I would hate to be suggesting something illegal. But logic and common sense tell me that volunteering for free is not really "working" for IRS and USCIS purposes. And signing bonuses are not illegal either.
