got a K3 and going for a CR1 visa

Hi all,

I need your help VJs. I got a K3 visa a month ago and I am currently in the US, My CR1 interview has been scheduled for October 23th. I am thinking about going back home for the interview to get the CR1 visa, which I know is far better than the K3, and will save me the hassle of AOS. My worry is that they may cancel my K3 visa during the interview and a worse scenario of having to deal with the AP.

Does any one had or know about a similar situation, is it a common process to cancel an already given K3 visa during the interview or not?

Also do you know if I have to take the medical exam for the new CR1 interview knowing that I just had one for the K3 visa two months ago.

Note that my case is very simple; I have no financial worries or any special circumstances, just the worry from a bad consular officer.

The AOS can be applied for at any time.... I simply would not go back for this reason having to endure the long flight, hassle or risk, etc.....

The results of the medical exam are in the USA and not at the consulate.... Even if possible it is hard to imagine how it would ever get back in time.

The results of the medical exam are in the USA and not at the consulate.... Even if possible it is hard to imagine how it would ever get back in time.

Further more, you will spend less money going through AOS than CR1 if you considered the ticket cost.

And the uncertainty of visa after the CR1 interview. You are better here then at the mercy of US embassy in morocco.

Economics, uncertainty and what you already have in hand will make a clear picture in your mind.

i have an identical situation as you

my husband received his K3 visa on April 10, 2008 ON THE SAME DAY he got his interview packet/interview date for CR1

it was an agonizing decision however, with the advice of the lawyer, he gave up his K3 visa persue the CR1

we had no idea what was going to happen

he had the visa (and ticket out of hell for one month)

ultimately it was my call as to what we would do

yes, the lawyer said waiting for CR1 was way better but I was extremely concerned about AP

we got AP for 12 days with K3

now we have been waiting 4 months in AP for CR1

we feel hopeless and helpless

if i could do it again, I would have brought him here IMMEDIATELY on K3, no questions

and if money is not an issue, just do the things here

i thought a K3 was only good for 4-6 months..IT IS GOOD FOR 2 years

the DOS representative just laughed at me and told me to sue my lawyer for such misguidance

now what is the hold up? he got one visa but under such scrutiny for the other

it just has been a total upset

i would recommend taking your chance with K3 ...AP is almost inevitable.

they cancelled my husband's K3 at the consulate on the spot.

Also we had the same ? we just did medical exam for K3 so what about CR1 interview, which was just a month later?

well we werent sure if you could use it, after all they are 2 different visas

we went ahead and did the medical thing over again, just to be safe, you never know with this numnuts

turns out, we didnt need to and we wasted our time and money

what else is new :angry:

Thank you all for the reply and thanks Sandrila for the details. I hope your AP waiting will be over soon.

I guess I will just apply for AOS here and money wise it will be less expensive than travelling back for CR1. My only reason for seeking the CR1 visa is the Permanent resident status you get right away and as my wife is planning to go to college there is a lot of money at stake between resident and non resident. So I guess I just have to put up with that extra cost for one or two semester and go the AOS way
