hi fellow VJers! i miss posting on this section! hehe!

well, this post is for my cousin's concern who's planning to annul her husband who's been very irresponsible to them. so, anybody here who filed an annulment case? how did you do it? how's the process? how much did it cost and how long did it take?

It took us 1 yr and 8 months to be exact and cost 200k.God bless and good luck to your cousin..

Pschological incapacity was my ground for filing an annullment..

According to the lawyer I knew, it depends where to file the case. Some cities/municipalities grant annulment faster than others like in Batangas (according to the lawyer) but of course, you should be living in Batangas for you to be able to file the case there OR you can use your relative's (if you have one) address in Batangas.

As expected, annulment case is so expensive. You need at least Php 100,000 (as a start) for you to get a lawyer, psychiatrist and psychologist. Then more money for lawyer's per appearance fee and other expenses.

The average time I know for annulment case is 1 year. But there are cases that you can get it for 6-8 months!

It will also depend on the husband. If he shows up in court and defends himself to all the allegations that has been filed against him, that will add more to the number of months to wait and the annulment case may even be denied. The court is pro-family and if possible does not want to annul a marriage. It will always depend on the judge though. If he/she is honest and goes by the book then your cousin has a long way to go.

I filed for annulment in December 2000 and paid the following fees:

P100,000 - lawyer's acceptance fee

P 3,000 - lawyer's appearance fee per hearing

P 25,000 - psychologist's fee

P ??? - miscellaneous fees (stenographer, photocopying costs, etc.)

Lawyers' fees vary so your cousin needs to scout around. Before hiring, she must check on the success rate of the lawyer. Better to hire someone magaling kahit expensive kesa naman palpak (excuse my term) na mura.

Annulment takes anywhere from 6 months to 2 years under normal situations or if the other party is not opposing. In my case, it took me 2 years 3 months from start to finish but then I was not really following it up as I was not in a hurry (I was not in a relationship at that time).

hi! Just to add to those who replied...well, i too filed for annullment

sometime in 2005 in Cebu City and in about 8 mths got what we prayed for...the

annullment and the sole custody of my son. I guess i am the only

one here who paid the least...all in all it cost me about 25T. I once

worked at the court so i got a good deal from my lawyer.

My second annulment was called "Petition for Re-Affirmation of Declaration of Nullity of Marriage" since I cannot file another annulment for the same person on the ground of Res Judicata (or a prior declaration of nullity). I hired the same lawyer who did my first case. Acceptance fee for the second case was a discounted P25,000 plus appearance fee per court hearing. I can't remember now if I paid P3,000 or P5,000 per appearance for the second case.

Here's a timeline for my second court case:

3-02-06 - Filed petition

6-06-06 - Decision rendered

6-23-06 - Finality issued

6-28-06 - Registration

8-??-06 - Annotated MC issued

The court procedure took a little over 3 months. The judge was very mabait (kind) to me and he gave me the earliest court dates that his calendar could accommodate. And I did not pay him a single cent for "padulas". Bait ano?

I been through about the annulment in cebu philippines and it cost not more than 60thousand pesos..i been filled May 2005 and finished November 13, 2006..My attorney is Atty. magnificus Canete in cebu philipines and my judge is Judge Ulric canete in mandaue cebu ..my doctor is doc. Elano from mandue.That amount was included the doctor already..They are very smart about that case..

Yep! Bait nga. The judge who took my case was known to be strict. She is known not to grant the annulment because she is really pro family so there's no way you can pay padulas. I was just shocked that she made her decision after a month. So from petition to decision, it took 4 months and 1 month for finality. She probably took pity on me because of all the evidences we presented. My lawyer even told me that its the most shocking annulment case she ever handled.

That's great! She's in Batangas. Because as I've posted earlier, according to a lawyer I talked to Batangas municipal courts grant annulment faster than other cities/municipalities. Though, that lawyer's office is in Makati. She can accept the case from provinces but of course you need to pay more :huh:
