As many members are confused and in a panic (rightly so) I wanted to give this its own thread as many are asking this same questions pertaining to dates.

NOA1 will have both a 'received date' and a 'notice date'

NOA1 received date, is the date that your petition was physically received at the service center. The petition is also stamped with this date when it is received.

NOA1 notice date, is the date that your petition is entered into the system and a notice issued.

IMBRA as well as the processing dates with USCIS goes by the received/receipt date (priorty date).

So for peace of mind.....please check your NOA1 notices to make sure you are looking at the right date when you are trying to ascertain whether your petition will be affected by the IMBRA or to guage when your petition is 30 days past processing. If your received date on your NOA1 is dated March 6 or after you will fall under IMBRA.

Thank you Aussie! I am trying to get hold of my finace so that he can check that out on the mailed version of our NOA1 but I have checked the UPS tracking and know it was delivered on the 27th Feb - is that what they count as the received date? OK so I am being impatient not waiting till I can get hold of him but all this stuff makes me nervous..... :blush:

Two minor points of clarification:

- the Received Date is the date that the USCIS facility recognizes that they have received the petition, which may be the same day that it was delivered to the facility or it may be a day (or two) later.

- the Notice Date is the date that the case was entered into the 'notice-generating system', which may not be the same date that the case was entered into 'The System'. My understanding, from posts by a former poster who visits the SCs to learn how they operate, is that entering case information into the notification systems (generating the NOAs, the On-Line Status, the e-mails) is done separately from and after entering the cases into their own processing system.

The differences are minor, I think, significant only to those who count the minutes.....

I think you're correct that the Receipt Date is the date that people should go by with regard to the queue.

From reading the act and my understanding of it, there is nothing in it that gives any indication that it is retroactive, so received dates prior to this will not be affected.

Our NOA1 says received February 27th, notice date March 8th

and the NOA2 says received March 7th, notice date May 11th

Is it the 27th Feb date that counts in terms of the new law? Please say yes.....

Keeping my fingers crossed for everyone that delays will not be too long!!!!!!

An excercise for you to do which should make the NOA's easier to understand. Put your NOA1 & NOA2 side by side.

Example

NOA1..................................................NOA2

Received Date: October 13, 2005.......................Receipt Date: October 17, 2005

Notice Date: October 17, 2005.........................Notice Date: November 22, 2005

Priorty Date: 'will be blank'.........................Priorty Date: October 13, 2005

Highlighted in RED is the NOA1 Received Date & NOA2 Priorty Date. This is the Date by which USCIS uses and also the date that we use to guage whether our date is past the processing date.

If you look at them both together, using how I have highlighted them, there is a pattern.

Also note the different use of the term Received & Receipt. I think this is where the confusion is coming in for many. Ignore the NOA2 when it comes to IMBRA or anything else for that matter. If you note you will see that all the receipt date (NOA2) is, is the date that the NOA1 (Notice Date) was generated.

The above table is assuming too that they have sent I-797C for NOA1 & I-797 for NOA2. Discussions on the board in that past have never been quite able to see any pattern as to which one is used for what as it appears to be random. From memory the I-797 is an older version. I-797 seems to use the term Receipt & I-797C uses Received.

I did notice that there is a day different from your NOA1 Notice Date & the NOA2 corresponding date.....one is March 8, the other March 7, and I am going to hasten a guess that this was an error.

Look, try as we will, there is NEVER gonna be uniformity with this.

Remember, these are the Feds and it's done by Civil Servants.

Priorities for a CS are "when is the next holiday," "when can I retire" etc. it's not our petitions or the concept of "loved ones."

As I mentioned in a post a few days ago, the Feds have been trying to address "interoperability" [getting computer systems to talk with each other between different agencies] for decades.

My NOA1 AND NOA2 BOTH do not have a Priority Date. Nada!

It may be a fun exercise pontificating and theorizing: it ain'ta gonna happen; there's no logic ... well maybe it's there is no consistency.

Mine: USPS tracking is 3/1/06 and the NOA1 Received Date is 3/1/06.

I'll change my Timeline to reflect that; I thought the Notice Date on NOA1 was the official marker date.

This is the most unreal thing I've ever experienced so I just :no: and :lol: MAO!!

I do hope Maria gets here ....

and you have been a member for how long lol This is not theorizing as you put it....but you can think what you like

Did I say anything about NOA1 having a priority date. And if you wish to keep going on about your NOA2 when all that is, is the notice that have approved the petition, nothing to do with anything to do with IMBRA or guaging when one is near or passed processing dates, so be it
