co-sponsor affidavit of support question

Hi everyone,

I hope one of you can help me out with a question I thought was completely clear to me already...

My husband needs to be added to the household size of the co-sponsor and meet the 125 percent above poverty line to qualify right?

For example his uncle wih himself wife and two kids for a total of four to household would need to add my husband to make a household of five right? So he would need to earn 125 percent above poverty line for five ?

Thank you all for your help. We just began to panic because we are about 500 dollars shy of the minimum thanks.

This is false. Immigrants are included in the joint sponsor's household size. The joint sponsor, his wife, two kids, and one immigrant equals a household size of 5. It does not matter whether the immigrant currently lives or will live. The immigrant(s) is always included in the household size.

If your uncle is $500 shy of the minimum income for a household of 5, he just needs to show $2,500 USD in assets - checking, savings, equity in a home all count. Basically anything that is already cash or can be turned into cash within one year. If he can show more than $2,500 in assets, all the better.

The immigrant is included in the household size on the I-864. It's not possible to fill out the form correctly and not include the immigrant. 21a asks for the number of people being sponsored on the form, which is always at least one immigrant. 21h asks you to add up 21a through 21g to get the total household size. The OP's uncle's household size is 5.

EDIT - I was confused at first thinking the OP is the petitioner rather than the immigrant. The household size of the uncle is still 5 though - the uncle, his wife, two kids, and one immigrant.

Hi, NYN, I was looking at your other posts and see that you are the petitioner and your husband is the immigrant, correct? So I've confused myself twice! You say that the joint sponsor is his uncle - his uncle lives in the US and has US-based income, correct?

Also, here's a section of the I-864 where it explains how to count the household size -

"Your household size includes yourself and the following

individuals, no matter where they live: any spouse, any

dependent children under the age of 21, any other dependents

listed on your most recent Federal income tax return, all

persons being sponsored in this affidavit of support, and any

immigrants previously sponsored with a Form I-864 or Form

I-864 EZ affidavit of support whom you are still obligated to

support. "

The part in italics is the part that means your husband, the immigrant, is included in the household size for your uncle, making the size 5 people.

When you said the uncle's income was $500 short, that was for a household of 5 people, correct? Hopefully! And hopefully it's not too hard for the uncle to show that $2,500 in assets needed to make up the difference.

Thank you everyone for your help. I thought my husband was added. I guess my husband misunderstood and miscomunicated and his uncle is not making enough =(

All the people that ¨want to help¨ us are suddenly disappearing. I don´t blame them, but I wish they had pulled out sooner so we could get the ball rolling.

To complicate matters my husband has some family members that left and are in the US with no papers, and so getting many of the co-sponsors we want might endanger us and them. =(

Anyhow thanks all, and I will put another posting for yet another silly question plaguing my husband.

Aw, how frustrating! Is it possible for you to lend money to the uncle for him to make up the difference in income? Is the difference even more than $500? Feel free to PM me if you'd like help trying to work it out.
