Embassy-DOS Inconsistency

Hello everyone,

As you know I am waiting to hear about my husband's visa after 11 months of AP and no help from anyone except God, I am still hanging on. He is given an apointment date for this week at the embassy and I want to believe so hard that this is finally the time that he will get the visa. But I am not so naive any more after seeing their games for over 2 years since the beginning of processing so I thought his checks may get expired again. So I called DOS and they tell me nothing about the visa, and also that his case is "currently under security clearance." I mean COOOOOME ON after almost a year they still are doing the same thing?!! I don't have the heart to tell my husband who is waitng with his whole heart and soul for this August date to get his visa that he is still in checks. Did they word it in a way that was negative to me? I asked that if the checks expired and if he is back on them, they asked me if he submitted the passport and when I said yes, they said ya they are just doing the last checks on that.

I don't understand anymore, nor do I ever want to call DOS again and get my heart broken. I am sick of this already and I hate having hopes now because every time I get slammed.

I am hoping that God will help me and this embassy understand how this process works. I hope they tell him to redo the medical and not get more delays. Mentally this is tiring and it is making me into someone I don't even know. I sincerely hope I can regain myself and tht my husband gets this visa. 3 more days until the embassy appointment.

I learned very recently that phoning DOS is a waste, unless something remarkable has actually happened -- the personnel provide differing stories, differing details, and differing attitudes every day. Some experienced immigration attorneys recommended that I deal directly with the consulate. The way in which I got through was to phone the U.S. Citizens' assistance line, pleasantly insist on speaking with an American, explain briefly that there has been a delay with no answers, ask to be transferred to the department that processes this kind of visa, pleasantly insist on speaking with an American, and have my list of questions ready. If a foreigner tries to help you and will not honor your request to speak with an American despite your diplomatic efforts to achieve this, a good final statement is, "Sir (ma'am), you are not a U.S. citizen, so you cannot POSSIBLY understand the gravity of this situation. Please immediately transfer me to an American who will pick up the phone."

You may have already done this, but I wanted to post this as advice for others, and to confirm for you that spinning your wheels phoning DOS is exactly that. GOOD FORTUNE to you, si man.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Please forgive me for not being more supportive of you over these past weeks. I can sympathize with how you're feeling now. Not wanting to go through the turmoil of calling the DOS and being let down time and again.

I guess now is the time to hunker down.

Thanks. Right, it is time to hunker down. It is now obvious that DOS and the embassy do not update one another and are inconsistent. Best to go with what the embassy says. I am looking to Aug 14. I hope anyone who reads this will get help in understanding inconsistencies between DOS and the embassy should they face this same situation.

Tammy, do keep your hopes up. . .DOS said the same thing to me. . .they refer even to the processing of the passport itself as "Administrative Processing" It does not occur to their tiny little brains what those words do to us. Even the consulate sent me an email, after I had submitted the passport, telling me they were "completing processing."

Be strong, you are in the home stretch. It may really be back in checks, but I am confident they are doing the same thing to you they did to me.

What I finally did was periodically call and (get a new rep) and tell them I had submitted the passport, could they tell me if the visa has been issued yet. Eventually it got me the result I wanted.

Hmmm...so I guess DOS telling me today that the AP is being done in Washington and not at the Turkish embassy may very well be incorrect... :angry:

- 07/02/2009: AOS packet received

- 07/08/2009: Check cashed

- 07/10/2009: Received all 3 NOA1s

- 07/14/2009: Received biometrics appt.

- 07/29/2009: Case transferred to CSC

- 08/01/2009: Advanced Parole Documents Issued

- 08/06/2009: Biometrics appointment completed

- 08/11/2009: EAD issued (received 8/14)

- 11/12/2009: AOS approved

- 11/20/2009: Green Card in hand!

Right now there is nothing to trust or believe. As a famous quote by a DOS operator:

USC:"Is there any indication of when the the visa will be issued?"

DOS: "Ya, when you get it."

The day I got the letter from my representative saying the embassy had informed them the security checks were complete the VERY FIRST THING I did was call DOS.....and guess what they said? Yep, his case is still undergoing administrative processing. Three weeks later he had his visa in his hand.

Although I am sure you are aware that prior to the visa being printed they must run him through the CLASS system one more time and maybe this is what they are referring to. Or perhaps they just don't want to say everything is finished in case the embassy decides to do more checking because then, God forbid, you would actually know who to blame for the delay.

Belinda, what you said, REALLY HELPED. Thank you friend, you are both knowledgable and accurate in your input. Right, I know the urge to call DOS right away to confirm if the checks are done. Yes I fell into that and that is why I called. I do believe they did not say "done" because in truth, it is not done. The medical needs to be done still and the CLASS check may have been done between July 1 and the Aug 14 date to return.
