My fiance was raised by her Grand Parents.

Her mother lives in another country, her father is "Unknown".

Her mother left her and her sister when she was a newborn to be raised by her GrandParents. Her Grandfather was a Lawyer and I the Grandparents thought they could give the children a better life.

Her Grandfather died a couple of years ago, and on my last visit there in October 2007. Her Grandmother passed while I was there.

Her relationship with her mother is strained, and has been since her mother basically "Ran Out' on her.

I have been supporting my fiance since her Grandmother passed. I got her thru college.

She has an aunt in Canada. Whom helped suport my fiance before I entered the picture.

My question is:

What would one do if we can't get hold of the mother to sign " Paper to Marry from Embassy" since I read on here if you are age 18 to 21 you need parental consent.

What should I do, and she will not be 21 until next February.

Jesus, strained, broken, bent, or not. Why wouldn't the mother at least be able to help with her consent ?

You must try... :star:

hello there!

you dont parental consent when u obtain a LEGAL CAPACITY to contract marriage at the USembassy...

but when the two of you will apply for a marriage license at the civil registrar she will need someone to sign there,

as for my case my mum signed at our marriage license, i was 22 when i got married.

im not sure if a gaurdian can do it.. it is best is you ask your fiancee to inquire at their local civil registrar.

We will be married in USA.

What is "Legal Capacity to Contract Marriage". Is that a form, What is it? Whom signs it?

I read in another post on here that you need signed parental consent to marry if age 18 to 21.

Does that need to be notarized?

And where do you get the consent form.

Do you make it your self?

They don't communicate.

Her mother basically abandon her as a new born.

I sure hope some one can help me get this handled.

Is there any website or information to read about Parental Consent in PI regarding marriage and K1 Visa.

oh i thought your gonna get married here,

you dont need to have that paper when you will get married in the states..

as far as I know they only ask for a parental consent during CFO,

dont worry about it.. just continue processing her K1 visa.

you guys will be ok.

I thought CFO was part of the Visa Process.

Doesn't she have to go through CFO.

If so, Won't she have to present Parental Consent, since she is only 20.

CFO is the last part of the whole process so you will have a lot of time..

maybe she can ask her mum to email her a letter of consent, that will do.

The CFO does require a notarized parental consent when the fiancee is between 18 to 21 years old. They may or may not ask for one but it is better to obtain it beforehand. This is in compliance with the Philippine Family Code that any Filipino citizen who contracts marriage between 18 to 21 years old must present a notarized parental consent when applying a marriage license. Although there will be no license needed ( since its a K1 visa) the CFO still requires this document during the seminar and counseling.

Aside from the grandparents, does she have any proximate relative in her area? How old is her sister? If she ( sister) is over 21 then she can sign the consent ( as provided for by law - hereunder quoted)

The family Code of the Philippines speaks of Parental authority as follows:

"Art. 216. In default of parents or a judicially appointed guardian, the following persons shall exercise substitute parental authority over the child in the order indicated:

The surviving grandparent, as provided in Article 214;

the oldest brother or sister, over twenty-one years of age, unless unfit or disqualified; and

The child's actual custodian, over twenty-one years of age, unless fit or disqualified"

Your last option is to talk to the mother and let her email/mail a consent for her daughter to marry you.

Hope this info helps.

So let me be clear. She will not need it for US Embassy but will need it for CFO if she plans to wed in USA.

If that is true, then she will need it as part of the Visa Process.

She has no contact information for her mother.

So what should be my next step?

Correct, CFO is not needed to be issued the visa. It is a requirement of the Philippine Gov, not The US Embassy. Your fiance will need the sticker from CFO in her passport to be able to board her flight to the USA.

How bout Jom's suggestion?

How bout Jom's suggestion?

For her to get on a plane and leave then we need a" Parental Consent".

I am going to look in Jom's Suggestion.

She does have a 24 years old sister, whom will sign off.

I just hope the CFO, does not try hold up the CFO stamp due to not having "MOther" sign it.

I initial meet my fiance back in March 2007 while eating at a Jollibee, it was out of the blue.

I had to make the decision to let her finish her education before applying for K1, It was a tough decision to postpone everything a year, she graduated March 2008.

So Now I am ready to get this process on the road, and secure and have all documents done early, so in case we find a problem (like Parental Consent) we can figure a way to handle it, and not have it delay our visa.

This is great news. Her sister can sign the parental consent in lieu of her mother. Just make sure that in the parental consent drafted by the lawyer ( it has to be notarized) make mention of the Article that I quoted and most importantly that your fiancee has lost contact with her mother for years now and they really have no communication and that it is her sister who has been her guardian and whom she look up to for authority.
