Parental Consent - My Fiance is only 20 years old

My fiance was raised by her Grand Parents.

Her mother lives in another country, her father is "Unknown".

Her mother left her and her sister when she was a newborn to be raised by her GrandParents. Her Grandfather was a Lawyer and I the Grandparents thought they could give the children a better life.

Her Grandfather died a couple of years ago, and on my last visit there in October 2007. Her Grandmother passed while I was there.

Her relationship with her mother is strained, and has been since her mother basically "Ran Out' on her.

I have been supporting my fiance since her Grandmother passed. I got her thru college.

She has an aunt in Canada. Whom helped suport my fiance before I entered the picture.

My question is:

What would one do if we can't get hold of the mother to sign " Paper to Marry from Embassy" since I read on here if you are age 18 to 21 you need parental consent.

What should I do, and she will not be 21 until next February.

you dont parental consent when u obtain a LEGAL CAPACITY to contract marriage at the USembassy...

but when the two of you will apply for a marriage license at the civil registrar she will need someone to sign there,

as for my case my mum signed at our marriage license, i was 22 when i got married.

im not sure if a gaurdian can do it.. it is best is you ask your fiancee to inquire at their local civil registrar.

Her mother basically abandon her as a new born.

I sure hope some one can help me get this handled.

I thought CFO was part of the Visa Process.

Doesn't she have to go through CFO.

CFO is the last part of the whole process so you will have a lot of time..

The CFO does require a notarized parental consent when the fiancee is between 18 to 21 years old. They may or may not ask for one but it is better to obtain it beforehand. This is in compliance with the Philippine Family Code that any Filipino citizen who contracts marriage between 18 to 21 years old must present a notarized parental consent when applying a marriage license. Although there will be no license needed ( since its a K1 visa) the CFO still requires this document during the seminar and counseling.

Aside from the grandparents, does she have any proximate relative in her area? How old is her sister? If she ( sister) is over 21 then she can sign the consent ( as provided for by law - hereunder quoted)

The family Code of the Philippines speaks of Parental authority as follows:

"Art. 216. In default of parents or a judicially appointed guardian, the following persons shall exercise substitute parental authority over the child in the order indicated:

The surviving grandparent, as provided in Article 214;

the oldest brother or sister, over twenty-one years of age, unless unfit or disqualified; and

The child's actual custodian, over twenty-one years of age, unless fit or disqualified"

Your last option is to talk to the mother and let her email/mail a consent for her daughter to marry you.

This is great news. Her sister can sign the parental consent in lieu of her mother. Just make sure that in the parental consent drafted by the lawyer ( it has to be notarized) make mention of the Article that I quoted and most importantly that your fiancee has lost contact with her mother for years now and they really have no communication and that it is her sister who has been her guardian and whom she look up to for authority.
