My husband and I were just married in Canada on 2/29. (I'm a US citizen.) We had intended on filing for the K-3 but then I have seen several posts on here that they are not being processed now ???? I'm at a loss. I don't know what my next step is. I just want my husband with me. I have three children from a previous marriage and he has two- of which he has full custody. We just want to be a family and get on with life. I know so many of you here can understand what it's like to finally find the person who completes you only to be separated by so many miles.

Does anyone have any advice ? What route do I need to go if they are no longer accepting the K-3 ?

Thank you so much in advance. I appreciate any help or advice that anyone has to offer. I'm here for the duration of my journey and hope that as I learn through this process I'll be able to help others like me as well.

File an I-130 for husband, and an I-130 for each child to USCIS, this will get CR-1 and CR-2 immigrant visas for husband and children.

There is no definite report on USCIS site that they ahve stopped K-3 only several posts here on VJ of having K-3 stopped in favor of the superior CR-Immigrant visa.

You can still attempt K-3 bu filing I-129F for it after getting NOA1 letter for the I-130.

File an I-130 for husband, and an I-130 for each child to USCIS, this will get CR-1 and CR-2 immigrant visas for husband and children.

Thank you.... I wasn't sure if I could file an I-130 for the kids... they are stepchildren and I've not adopted them....

Read the I-130 directions, US Citizen can file for step children if marriage happened before the children's 16th birthday.

They can be submitted together in same envelope, just dont share any evidence, make copies for each I-130 package. The cover letter should note that there is more than one I-130 enclosed.

If you are sending more than one case in an envelope, clearly separate the cases by rubber band or clip fasteners.

The step-child filing limitation is marriage occurs before child reaches age 18, not 16.

You will want to treat each I-130 petition package as a separate entity until you have it fully ready to go. Then I would write a cover letter indicating there were multiple I-130 petitions included in the package. I would also include a separate cover letter for each petition, listing its purpose and contents in order of appearance.

For Canada, the CR1/CR2 path for your husband and children will take extra time but you'll be saving a couple thousand dollars going the immigrant visa route instead of the K visa and he'll be work authorized virtually on arrival.
