Update on the K-3 Situation (Canceling the I-129F)

I wrote to my senator's immigration staffer asking about the situation with the K-3 petition. She contacted the VSC congressional liaison and here's is what she wrote back to me:

"I checked with a Congressional Liaison at the Vermont Service Center about what they are doing with I-129F's (K-3) once the I-130 has been approved. I was told that since there is no fee associated with the I-129F they take no further action on it if the I-130 is approved first."

Looks the rumors are true about no more K-3 petitions after July 2007...unless somehow the I-129 gets approved first...which is almost impossible given you send in the I-130 first.

REALLY... ya my i129f the fee was waived since i paid the 355 for i 130...man that just a heartbreaker.. now i130 ughhh can they evermakeup their mind... i wish the process would move fast for i130 since therye cancelin k3's...... i am getin real impatient with uscis now... does anyone know what dates they are processing at VSC?????

really YA!! your case does not make sense? :( why did they cancel your i129f first and not even aprprove i130?? did you inquire about that??

5-13-08-mailed AOS i864 packet w/printed cover sheet from online payment (certified mail- priority)

5-15-08-AOS packet received by NVC

5-18-08 iv FEE bill invoiced

5-18-08 iv fee $400 paid online

5-20-08-iv fee cleared, able to print covr shet online

5-21-08-mailed DS230 packet to NVC via priority mail

5-29-08 aos ACCEPTED

5-29-08- DS 230 entered in system

6-3-08-cse cmplte.

6-11-08 case left NVC to chennai via DHL

6-16-08 case reached chennai

7-2-08 appt letter received by beneficiary

7-4-08 medical done in chennai

7-28-08 interview- AP for 4-6 weeks (awaiting name chk clearance-told by chenai operator)

8-20-08 chennai forwarded file to DOS- according to inquiry from congressmans office

(also confirmed by DOS)

8-28-08 file reached DOS- told by operator

9-2-08- last update to case,told by DOS

12-12-08 emailed chennai embassy asking status of our case, and got email to send passport..

12-15-08 submitted passport to vfs

12-19-08 VISA ISSUED! in hand!

12-25-08 hubbys arrival! smooth POE!

1-16-09 green card arrives

1-27-09 SSN card in mail

Of course I have inquire about this, I called USCIS every week!! And I have ask my congressman and senators to do inquiries for me, I am still waiting!!! Because most likely ( I been told) that since my husband is from the middle east he will have AP as well when we get to the Embassy and this will also be more waiting :(:(

I just thought of that today...that is exactly why but there's a bunch of us where NOTHING has been even touched for MONTHS and yet others that applied after us are getting their I-130's approved (and I-129F is cancelled)! We paid the $355 where others paid a lesser amount! They at least had a choice of which to pursue & we don't! We're stuck & because we aren't outside of processing times, not a damn thing can be done. This is even after the fact that this was THEIR instructions! Typical bureaucratic bull@#*!

Well, we decided to send the I-129F before the increase....so we ended up paying for both the I-130 and I-129F. And our I-130 was approved before the I-129F, so we were lucky that our I-129F was not cancelled. Huummm....maybe it was because we payed the fee for the I-129F....well, who knows, USCIS never follows the same procedures with everyone.

3.17.08 - Received both NOA's in the mail

5.05.08 - EAD Card Production ordered GOT EMAIL (we received the same email on 5.09.08)

5.13.08 - Approval Email for EAD (so the card was ordered first, and then we were approved...hum)

This news is actually work for me because my hubby filed I-130 on Aug07 and I had NOA1 by Dec07, NOA2 by Feb08 so we kinda backward when we sent in I-129F just right after got NOA1. I dont care much about the fee but it is tired of thinking I-129F gonna take another 4 months atleast to be approved. So, if they move on with my i-130, it is good enough. Normally encourage myself that as you move foward with CR1, you will have green card 10 years by the time you get to US and you can apply for working permit right away. That good news for me, thanks for the post.

As I posted in the CR1/IR1 forum, for those of you that paid for the I-129F & had it "administratively closed", if I were you, I'd be making a stink about it in a big way! That is YOUR RIGHT, to have a CHOICE as to which visa route to go! How can they get away with this if you PAID for that option??

My 130 and 129 were paired up. I was told that both my cases were with ONE officer.

On Jan 3, Both my applications were touched. The 130 approved and the 129F administratively closed.

I don't understand because my adjucator, "could have easily" approved both but didn't.

In my case, it seems they purposely did not processed my I-129 and "waited" for my I-130 to get processed.

Still... this closing of K3s is not a rumor. I dont understand why USCIS doesnt want to make an official statement.

You're right YGandMAT. I remember your case, You guys were just about a week ahead of us and paid for the I-129.

I was late in filing for my I-129 and ended up not having to pay for my I129.

In our cases, the 129 fee or none fee determined our K3 and CR1 cases respectively.

Our case was in Vermont too. I-130 was approved last May 7, 2008, I-129F still pending (we received notice fee has been waived). We are still waiting for the I-129F to be approved. What is the best remedy/option for this now? im totally confused with this situation. Is vermont will still pursue our I-129F? Thanks

I do not understand the whole no fee for I-129F so no treatment reasoning.

It's not like we could have chosen to pay for it anyway. The fact that we filed it means that we want K-3 and not IR-1/CR-1.

So I think this reply is pretty outrageous.

It response also doesn't explain the difference between California (for some cases) and Vermont.
