My K1 Visa rejected - will return back to u.s.

Hello all,

I am new on this board. Here is my K1 denied petition issue. Please give me any advice if you can. I was introduced to my fiancee in Vietnam in 2006 but I lied in my petition that I met her in 2004. I have no supporting evidence of the relationship between 2004 to 2006. I have evidence from 2006 until now. So, basically they rejected my application and saying that we lack of evidence since 2004. They want to return my petition back to the u.s. for appealing. They didn't tell me when will they return? I have no clue what to do next?

Any advice here? I did the petition all by myself. I didn't go thru. lawyer or service agent. Now, it is too much trouble and headache for me. Helppp. I wrote a letter to my Senator, do you think they can help out my case?

Did they catch you in that lie or is it something else they are denying?

When did you file the initial I-129F? and if I may ask, why did you feel the need to "lie" about meeting dates?

Senators cannot get you amnesty for your mistake I am afraid....

If they caught a lie its prob over with the return, why in the world would u lie on something like this that has to be documentd and proven, there would have been steps to try and get it held there but i doubt now> it will probably return only to expire, and then you will have to re file

Who rejected your petition? Was it rejected by USCIS or was it rejected by the consulate?

why did you lie? :(

If you have an honest bona fide relationship, you met in 2006 in person, you could have filed 2 months later and you would have met the requirements.

You didn't have to know your fiance for 2 years prior to filing, many people get that mixed up.

You only had to have met once in the last 2 years prior to filing.

You are absolutely right... I shouldn't need to lie.

"You didn't have to know your fiance for 2 years prior to filing, many people get that mixed up." --- I got this mixed up.

I met her in Dec 2006 and filed a petition in March of 2007, that was perfectly the right timing. I thought I have to meet the person in 2 yrs that is mainly the reason why I lied. I know that I am a badddd liar.

This thing is very highly sensitive but as a first time petitioner, I am so clueless and didn't understand the procedures. I didn't read much on this board before going doing the steps. Now, it is a baddd mistake. What is the correction to this prob? Will I need to refile and forget the old one?

I think it is at the consulate because they said they were returning the petition to the US.

Yes, u.s. consulate officer in Vietnam embassy rejected my petition.

Sweetheart, I'm sorry.

You must be completely beside yourself. It was a mistake, mistakes happen.

Take comfort in your fiance, in your love, in your relationship. Work through it together.

I don't know what will happen now. You could get married and file for a K3. I have seen people who were rejected a K1 and successfully file a K3 or CR1.

You may want to wait it out though, you could explain to them you misunderstood the requirements. They may be lenient.

I wish you all the best in whatever direction this journey takes you.

give it some time to see if it truly comes back, then you will need to know for sure this one has expired or closed before you refile its just going to take alot of time to let it run its course. Did you get the pouch number it was to be returned in i would say get your rep involved but i dont expect theres any actions that corrects a false statement now, not understanding i dont think would fly as a reason

Honestly I don't know what to tell you. Your intent was to commit fraud, even if you now realize it wasn't necessary. That sits rather poorly in my craw.

You could try re-filing, but they're not just going to "forget" what you submitted before. Depending on how you worded your initial packet I suppose you could try to explain it off as a mistake, but then you are once again lying. To paraphrase Einstein, the definition of insanity is doing the same thing again, expecting different results.

You probably need a good immigration attorney at this point to untangle your mess. Good luck.
