Ok, this is a long mess.....but basically:

My husband was denied a K3 visa March 10, 2004 due to admitting he used marijuana within 3 years. They told him to reapply March 10, 2006. So, he got a visitor visa. Once here we were advised he could adjust status. So we filed the I485...it too was denied. Then we filed the I212...check cashed and no notcie or response for over a 10 months. We went in to immigration adn they said his case was in storage and nothing new was being done. So, now that it is after March 10, 2006 can we re-file the I485 even though his visitor visa expired....I don't think he is considered illegal if we filed the I212 and were waiting a response. Not our fault they did nothing with it and sent it to storage. I even have the cancelled check they cashed for it. If not a 485 then what? We have been married 3 years almost, have 2 kids, a house and a life together here. He hasn't seen his family in Mexico in over 2 years so we want to get this done ASAP so he can go visit them again. HELP!

Wow, that is really tough. I would DEFINITELY hire a lawyer to make sure that this gets done right. You don't want anymore denials.

6/19/2002- Met Online

11/10/2002- Met in person for the first time at Buffalo International Airport we spend a blissful but all too short week together.

2/23/03- David proposes on the beach in Melbourne Florida at sunrise during his second visit.

9/26/03- After much talk with USCIS we decide to go ahead and get married during David's third visit, with David planning on returning to Ireland the following week.

9/30/03- Phone USCIS to ask questions on filling out paper work and USCIS officer informs us that if David is already here he doesn't need to leave. After numerous calls to the Irish Embassy and two more calls to USCIS to confirm, we decide he will stay.

12/02/03- Petition for AOS recieved

10/8/04- EAD FINALLY arrives

11/10/2004- Our Son Colin Michael Kieran born two years to the minute after our first face to face meeting!

1/26/06- Recieved interview appointment letter.

3/09/06- AOS approved! David is a permanent resident with stamp in passport.

4/4/06- Green card arrives. We are now free to travel back to Ireland so David can see his family for the first time in more than two years.

16 May 2005 - Assembled health package, W2s.

11 July 2005 - RFE: cheques inappropriately placed.
18 July 2005 - NOA 1: I-485, I-131, I-765 received!

15 January 2013 - Sent package off to Phoenix.
28 January 2013 - RFE: signature missing.
06 February 2013 - NOA 1: N-400 received!
27 February 2013 - Biometrics appointment (Detroit, MI).
01 April 2013 - NOA 2: Interview assigned.

15 May 2013 - Naturalization Interview, approved after 15 minutes.

10 June 2013 - Naturalized.

yeah I don't think there's much advice we can give you... also contact your local congressman. and I know what it's like not to have seen your own family for over two years! Here's me wishing you the best!

Oct. 6: NOA for AOS, EADand AP received, case was moved from the DC office to MSC

Nov. 23: Biometrics and fingerprint appt.

Nov. 24: AOS and EAD touched

Dec. 3: EAD arrives in the mail!

Sept 19, 2005: E-filed EAD renewal

Sept. 20: I-485 transferred to CSC

Dec 20: RFE notice received

Feb. 13, 2006: RFE received in CSC

Feb. 23: AOS approved
