Confused about 2007 taxes while having spouse under CR1

i got married in 2007, so im confused about how i file my federal and state taxes since my spouse, does not have an alien resident number. I file the 1040EZ normally. DO i file single...married...or what? and does my spouse have to file anything?

Is your spouse in the US already?

When we were in canada, my husband filed as "married filing jointly" and indicated that I was a "non-resident alien".

do the w7 form get him a tax id number and file married. You can just attach it to your income tax form but he needs to sign and u cant do the quick file.

go to the internal revenue site and it explains all and give u the form

no my spouse is still in El salvador....

and mine is still in Morocco doesnt matter thats what the w7 is for

You can chose several ways to file if you are not living with your spouse. You can get your spouse a ITN and file married filing jointly or married filing seperatly; or if you have lived seperatly more than 6 months during 2007, you can file as head of household (if you have a qualifying dependent) or even as single, if you so chose.

I was thinking the same thing...But I think you can only file single if your spouse is abroad and does not have a tax ID #.

Are you supporting him in anyway? If so, keep your receipts and then go see a tax specialist.

yes thanks for posting links im at work but that is what i did also and i just sent off the tax forms for him to sign and return to me. If your married in 07 you are considered married for the year take it to a tax preparer that is familiar with this w7 it is no problem at all and you do file as married joint if you choose to u need nothing from them except their signatures well not quite true there are requirements of paper work to do this one being copy of passport and i think i attached his birth certificate and wedding certificate also with the tax form and the w7 form

I was temporarily living in England during last years tax period. My husband is a British citizen, and we lived there temporarily before relocating to America a few months ago. I called the IRS at the American embassy, and they told me to file as married, filing separately. They told me to put "NRA" for non resident alien in the spot where it says social security number for my husband. The woman from the IRS at the embassy told me that made the most sense, because as soon as my husband moved to America he'd be getting a social security number anyway. She told me that the Individual Taxpayer Identification Number would be a waste of time for my situation.

Before I spoke to this woman at the embassy, I called the IRS in America. They told me to fill out the W-7 Application for IRS Individual Taxpayer Identification Number which you are all talking about. For me, in my situation, it was easier to put "NRA" on my taxpapers since my husband was getting a visa in a few months.

I don't know if this applies to your situation, but I thought I'd pass it on to you since it saved me a lot of stress!

I got married in October of 2005. My father prepared my 2005 taxes for me, and marked that I was single. I spoke to someone from the IRS about it after the fact, and she said that it wasn't a big deal. She said that I could send in a form to amend it if I wanted to. I haven't bothered.

You could file as single but wouldn't you want to take the larger deduction?

I called IRS helpline last nite and spoke to CSR and he explained to me. I can either file Head of Household, since I have a son to claim or I can fill out the W7 form and send that to my husband to sign and send back to me, then we would have to paper file of course. Then they would give my husband an ITIN #. No matter what, if your married as of Dec. 31st 2007 then that is your status for that year. So, it would not be single.

I usually do my own taxes, but this year I was a bit confused about it, so I called and waited for over an hour to speak to someone at IRS ya know. I am not sure of which one to do at this time, but this is what I was told last nite. I hope this helps
