It finally came in the mail today and what they want is the MEDICAL! They recognized that I completed it and don't need to get it again but they say they can't find it in their records so they want me to do it again. Ugh. Extra money for lost paperwork that isn't our fault? SIGH! By the way, we did get a photocopy - so I suppose we could send that - but I doubt they would accept it as it's not an original.

Anybody else had this for an RFE? Do you think we contact our Point of Entry and see if they can dig it up? It is NOT a year old yet - I had it done at the beginning of May!

That is ridiculous, sorry to hear that. Maybe you can try the photocopy and see. That sucks. Good luck. Unreal, how that could happen to you.

One can always try the photocopy but the RFE stipulates right on the face that it must be in a sealed envelope from the CS....

YMMV

Really, did not know that, had no clue. Guess one should follow the stipulations then, sorry Melyssa, I still feel for you it is n not fair or right, sucks. But you got the dose of stipulation from FWAGUY so sorry to dash your hopes. Good luck. :crying:

Here is a helpful post from someone who was able to locate a lost medical. Good luck, Melyssa.

Thank you SO much! I can't wait until my husband gets home so we can figure out what we have to do. We will definitely read those posts and look into contacting our congressman (once we figure out who our congressman is. ;))

We are also going to contact the doctor in Canada and see if she can find my medical her records, copy it and send them in. Does anyone know if USCIS will accept this? Should she send it to me so we can send it in, or can she send it directly to USCIS (with our info)? It seems like this should be acceptable but the form does say I-693 which is a different number than the Canadian medical. This makes no sense :(

Something else just occurred to me - I wonder if it would be possible just to go to the CS and get him to transcribe the photocopy of our medical (like he did the supplement?) Hmm...

Going to try contacting our congressman, too.

However you respond remember that the evidence submitted in response to the RFE needs to include the RFE request sheet (ie... the "blue" sheet) as per the instructions....

Thanks! Yeah that was why I thought maybe she shouldn't send it to them directly but instead just send it to me.

I finally figured out who our congressman is lol. :) Sent them an email and will try calling later probably, I just spoke with people who represented the wrong congressman for my district (based on more confusing info) who of course said they couldn't do anything so I need a break! haha

Yeah I know, if we can get them to transcribe it he'll probably charge money anyway. Hopefully it wouldn't be another $300 though. :( The supplement was already $25... just for the supplement... ugh. I guess it doesn't hurt to ask.

Just wanted to write a little update, and share some good news, in case anyone is following!

I finally made contact with my congressman rep yesterday. At first it was frustrating because she kept saying I had to get the medical done in the U.S. and that's how it's always done (!) and I didn't think she would listen to me. But then finally I read her the part where it says K1's are not required to get it done if their medical is not a year old, and she told me to fax her over some stuff. Besides her being willing to at least look into the situation, I don't have any good news on her being able to help me out with the medical just yet - but hopefully I will soon. We are just VERY thankful that she finally listened to me and seemed willing to help. Hopefully she'll be able to do something and at least we do have a couple of months to try to sort this out, although if she's unable to track it down... I guess we might just go ahead and schedule another medical to avoid more unnecessary delays. I really don't think it is fair at all though - for anyone this has happened to. We are praying and hoping that our medical will be found soon and our case can resume processing.

The good news is that I just found out our AP was approved yesterday! We were hoping our AP would be approved first - and this has come just a little bit sooner than expected. Originally, we weren't expecting to have it approved until February.

Yay! Hopefully EAD will be approved soon, too!

Melyssa,

We had the same thing happen to us...RFE for medical...my husband had the hospital in Turkey send the vaccination report and he took that with him to the new medical that we scheduled with a civil surgeon here in the US. They only charged him $175 for the medical since he'd already had most of the shots...and they're going to put together the whole package for us to send in for the RFE. I know $175 is still a significant amount of money to pay for something you alread had done, but its a lot better than $330! Hope you have some luck with your situation too...

Best Wishes,

Tanya

ROC Journey:

01/19/2010 - Mailed ROC paperwork to Vermont Service Center

01/21/2010 - ROC package arrived at VSC

01/26/2010 - Check cashed

02/25/2010 - Biometrics taken

04/23/2010 - Conditions lifted! :)

Outside of the US the doctors are called Panel Physicians. Inside the US they are Civil Surgeons. You can find the ones in your area by going to USCIS Civil Surgeons Locator.

Any news from your congressman's rep, Melyssa?
