IR/CR takes one year?

There is a lot of talk in the K-3 forum about the fact that there is considerable reason to believe that at

least some K-3 applications will be affected by the I-129F being cancelled and this paperwork then will be

processed for a CR1 visa. When I asked my lawyer about it, of course first he wanted additional funds ( so

what's new with lawyers, right? ) but second he mentioned that it will add another 12 months to my waiting.

He mostly deals with cross border cases in Texas, but is it true for cases like ours? Is is Embassy or country

specific? My I-130 application was approved last Sept and then the I-129F was filed.

You have already filed both I-130 and I-129f if you are a k3 applicant.

Why the lawyer wants MORE for a petition you have already filed, I don't know .. as you say lawyers!!

As for taking longer, I don't think so.

I am I-130 only (didn't file I-129f) and I filed May, 2007.

We are through NVC, and awaiting the consulate in China to schedule the interview.

I know that if you re-filed, then yes the I-130 would take another year, but it seems you have already filed both forms.

If USCIS, or NVC decides to process your I-130 instead of your K3, I would not think that would slow you down.

One thing to consider is the USC needs more documents available in USA if you go I-130.

The basic difference in process between I-130 and K3 is that the p3 portion of the work is done in the foreign country for K3, while it is done in USA for I-130. So, the documents your foreign wife would need to get together for K#, instead YOU need to get from her for I-130.

Does that make any sense?

Look at the James Shortcut link in wiki, or NVC flowchart and compare the documents ask for at NVC(for I-13) with the documents required for p3 (for K3).

I hope you get your I-130, and I hope you dont have to pay the lawyer more.

If the lawyer is doing your I-130 it will probably take you longer :)

Your I-130 was already approved when your lawyer filed your I-129F? Wow!

That is just wrong on so many levels.

  1. 1. He obviously wanted more money.
  1. 2. Your I-129F will be rejected because your I-130 was already approved. You see... I-129F applications require that you have a "pending" I-130 application.
  1. 3. Your approved I-130 could have been done with NVC processing before your USCIS can even reject your I-129F
I'd fire that lawyer then contact NVC and find out what's going on with your petition. I'd cut my losses and move forward with the I-130 if I were you.

I would like only to add that also in my humble opinion NoelandTinin is absolutely right.

Youtoo can you check if and when your lawyer has received DS3032 Choice of Agent form from NVC ?

If he received it and it was September I would fire him.

I did send an inquiry to him, will keep you posted if and when he decides to respond.

I feel he is just a money hungry good-for-nothing...................( you get the picture ).

Actually you may call by yourself to NVC to ask if they have your approved I-130.

You need I-130 number and beneficiary date of birth.

NVC phone: 603- 334- 0700 To talk with live operator pres 1, 5.

Line is busy so best time to call around 7.30 a.m or 11. 30 p.m. EST

Will I be able to pull information out without talking to a live operator,

for example just by entering case number, etc? Otherwise you mention

11:30 p.m., are they staffed 24 hrs? I have a 14 hr time difference here

to the U.S. East Coast. If I can get the info at any time that would be

great, otherwise I would call during their working times.

If there is not complicated situation this process is fairly easy.

I'm the beneficery I still learn English and because my husband is now busy with preparation to his March exams I'm practicly doing everthing by myself. Fee for lawyer we are saving for vacation :)

I must admit without VJers I haven't chance to do it.

Hang here and you became MUCH, MUCH more knowledgable than your lawyer

if you not already are. :)

To talk to live operator you might call between 7.30 a.m- 12.00 a.m EST

Automated system is available 24/7 so using your INS number ( I-130 receipt number -including first 3letters) or NVC number (if petition is at NVC they give you new number)you can learn about your case status.

BTW now is good time to call them :)
