Timeline

I just found out my husband is cheating. We have an interview this coming Wed and I don't want to go. I don't want to have anything to do with him getting his GC anymore. This is our first interview. All he has is a J1 waiver and his employment authorization card. What will happen to his case if I don't go to the interview. What should my next steps me to handling this case because I do want a divorce!

First thing would be to confront your husband...and the sooner the better. Let him know how you are feeling..and be honest...I would make it perfectly clear to him that if his only reason for coming over here was for a GC...and then cheat on you...that you're done...and you will no longer be a sponsor. If you no longer wish to be a sponsor to him...you will need to contact your local USCIS office and let them know why

13 Aug. 2007--Received NOA2

09 Oct. 2007--Medical in London

08 Nov. 2007--Visa Interview & Approved

14 Nov. 2007--Pete receives K1 visa in the mail

21 Nov. 2007-- Pete arrives in the United States (together at last!!)

27 Dec. 2007--Our 3 year anniversary of being engaged

16 Feb. 2008--We were married!!

If it's for real his cheating on you in such a short time.

Dump him! Anyone that dumb that can't keep his pecker in his pants until he gets his GC will only be more trouble down the line!

Go to the interview and tell them you are divorcing him.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I'd contact a divorce attorney, then send a summary of what's happened to the USCIS, and then refuse to go to the interview. Make sure you get your bases covered as far as the finances are concerned, but don't help or hinder his immigration case. Just take care of your interests and get him out of your life. Good luck!

I would bring the attorney to the interview to add to the validity of the fact that you are filing for divorce.

That is if you are going to get a divorce.

Unfortunately, this is going to cost you bucks. Contact an attorney after confronting this jerk. If he's cheating on you already then obviously you were just his way to get here. Sent his butt back as soon as possible but protect yourself first. Even though you are a woman, he could try to claim you have been abusing him and file for protected status.

"Once a cheater, always a cheater" :angry: If he is already fooling around just after 5 months, then he is not serious about your relationship. In fact, you should consider yourself lucky to have found out now, rather than after the interview! If you leave him now, you save yourself the headache and the money of a divorce. Get rid of him. He is a joke!

And by the way, there are still many nice guys out there! :thumbs:
