Hard time fillin out DS 156 can anybody help me???

hello everyone! just want to ask one question I was reading the questions on DS 156 #38 "Have u ever violated the terms of a US visa,or been unlawfully present in, or deported from, the US?" I was denied entry last year under section 212 (a)(7)(A):I sort of misrepresentation etc. was sent back thru "Application for admission withdrawn" flew back home using my return ticket. Should I tick yes into that coz correct me if i'm wrong I was sent back but I was not banned for a given time period? ooohh.... i'm so confused can anybody help me???thanks

Can you give a few more details?

From what you have written, it sounds like a visa was issued and then withdrawn??? Please explain.

If you never entered (you said you were denied entry), then you weren't deported. Perhaps you could explain why you were denied for "misrepresentation".

It appears you were not unlawfully present in or deported from the USA. However, it is NOT CLEAR whether you violated the terms of a visa. Please elaborate on why you were denied entry.

Please be aware that even if your correct answer to the question is "no", you are likely to be required to explain the denied entry, at interview. It is on record.

You were denied entry (presumably because you could not prove your non-immigrant intent?)

This is NOT the same as violating the terms of a US visa (you have to enter on the visa before you can violate the terms by working illegally or something of that nature). You were not unlawfully present and you were not deported. You were allowed to withdraw your application for admission to the US and you went home.

Check NO on the form and be prepared to explain the circumstances at the interview since they will know this happened.

here's the thing guys, I went there for the 2nd time, was sent to 2ndary insepection coz i stayed there for almost 5 mos. on my 1st visit, accdg. to the paperwork I got I was sent to 2ndary inspection as a sort of a look out due to my first visit since they think I stayed too long, I know that they just want to make sure If I worked there the first time or not honestly the real reason was my supposedly 2mos visit got extended to 5 mos. coz I met my fiance and we fell in love. I didn't tell that to the officer coz almost all my friends here & there in US told me that I shouldn't let the officers know that I have a fiance there coz they will not let me in.

The thing is I went there the 2nd time coz my fiance sent me a tiket as a gift so we can be together on my bday for 2 wks. We had no intention or whatsoever to get married yet at that time although we were already engaged coz we still dont know w/c route to take whether to marry here or apply k1 w/c ever is faster. What happened was I wrote the address of my fiance at the I94, after further questioning they discovered that I lied (w/s I really regret) about the address coz I denied it was his told them it was my sister's. I know that what I did was wrong and I truly regret it it. They discovered the truth eventually and I also admitted and explain to them the reason, I was sent back home and my visa got cancelled. Hope u guys can help me out.thank u all for ur time.

Did you actually overstay beyond the time given to you on your I-94? Did you officially request and receive an extension?

As you now know, lying to immigration will always result in bigger, more serious problems. You are lucky you were not denied due to misrepresentation.

Again, it certainly sounds as though you were simply denied entry. If you had been deported, you would know it based on the paperwork given. In any event, you should consult a qualified immigration attorney to clarify.

hi kitkat!thanks for the immediate reply, umm.. I did not overstay, on my 2nd trip i was denied entry due to I guess misrepresentation but I was given "withdrawl of my application for admission"

I guess i'll take ur initial advise and go for it. thanks so much
