First of all, this site is GREAT. I had initially planned on hiring a Lawyer to handle my filings, but this site has really helped me prepare to do it myself.

I am in the beginning stages of filing my I-129F and G-325A forms for my finace in Colombia. We are both obtaining the documents needed to complete the packet. Question: I understand that by filling out the I-129F form, it allows my fiance to bring her 4 year old daughter to the US on the same visa. (We are planning our wedding within the 90 day window granted by the K-1) Once they arrive in the US on the K-1 and after we are married, do I then file the I-130 for her daughter? Or do I go ahead and file it the same time I file for the I-129F? I understand the additional filings for "change of status" once we are married, but the I-130 is somewhat confusing.

Any help and suggestions will be appreciated.

Not sure about filing an I-130 for a child. I do know that a child is considered K2. There is information in the Guides regarding this.

Here's a link from the Visa FAQ's:

Yes...cart in front of the horse...

It's not part of the K1...

There should be no conflicting information on this for a K1. Check the guides above when in doubt.

hi guys. i have some questions while we're filling up electronically in pdf format the forms I-129F and G-325A.

In Form I-129F, in part A, there's the box for answering the question on the country on which the petitioner was born. my fiance was born in the philippines however, the spaces in the box are not enough to include all the letters of the word PHILIPPINES. so, it's only spelled as PHILIPPINE but with a "+" sign at the right bottom part of it. This is also the same with my address as the beneficiary. The spaces in the box for my street address are not enough to fully print my whole street address. so, the last part of it also includes the "+" sign.

so, my question is, do you think it's ok for the USCIS that we print these documents and submit it to them? i don't know if it's understood already from them that the address was really long so maybe it's ok to submit that document.

though, at the second part of part B, my complete address is listed there, so they will still get my complete address.

thanks. hope you can help me.

If I were you, I would forego the pdf and just handwrite it or use a typewriter as it is best not to leave it to USCIS to figure out what the "+" means - even if it's obvious. My husband's last name is very long, so I used a typewriter and was able to fit it all in...just had to be a little creative. :) After all, filling it out by hand or by typewriter were the only options until recently anyway.

Or you can fill out the PDF form, leave the answers blank that won't fit your entries, and fill those out by hand after you've printed the form. I've done this with filling out N/A or NONE for some of the entries that only accept numeric input.

Thanks for the help everyone. I have just about read every post on this site. Information overload! I do have a quick question regarding the process once the I-129F packet is received. Once I get the acknowledgement that the packet has been sent to her nearest consulate (Bogota, Colombia) will they then let her know what she needs to provide? Such as medical screening, birth certificates, police background check, etc? The initial filing of the petition is a piece of cake, it's all the follow up info. that has me confused. WIll she need to call the consulate after they receive it?

No so. The child will need their own visa. What the child does not need is their own I-129f petition - the child can apply for her visa on the basis of your petition for her mother.

Ok, now I'm even more confused. The consulate in her country will issue seperate visas, correct? I do not have to fill out any additional paperwork with the initital I-129F do I? I am understanding that the only thing I have to do is list her daughter on the I-129F. They both already have passports. We are just finishing getting together the necessary information to send with the intitial packet.

Bundy, I think you and Yodrak are at a crossroads of terminology: petition (I 129f) versus visa (which is stamped in the beneficiary's passport after a successful consular interview).

Bundy,

Correct the consulate will issue separate visas and correct you do not have to submit any additional paperwork for the daughter with your I-129f petition.

The mother and daughter will each have to submit their own visa applications.

You only need to provide the information about your fiancee and her daughter on the I-129F. After the application is approved she will receive a package 3 and 4. Package 4 will have forms for mother and child. The fiancee visa is the K1. The child ( being under 21 years old ) is allowed to "piggyback" and is a K2 visa. The child will also take a physical in Bogota and will need wriiten permission from the father to leave Colombia. This is a little simplified but not by much. Hope it helps.
