What form should be used for AOS co sponsor?

Hi Everyone,

What Affidavit of support form do we need for a co sponsor for the Adjustment of Status? My wife is a K1 Visa holder. We are planning to have my mother as our co sponsor but she is not living with us. Is the I-864A the right form to fill up?

Jan 27, 2007 Wedding Day

March 31, 2007----- Submitted AOS and EAD package

April 6, 2007 ------ Package received at USCIS

April 11, 2007 ----- NOA1 ( AOS and EAD )

April 25, 2007 ------ Biometrics

April 26, 2007 ------ Touched

May 21, 2007 ------- NOA 2 ( AOS )

June 13, 2007------- Receive email from Cris, EAD Card Production ordered

June 14, 2007 ------ EAD touched

June 18, 2007 ------ EAD touched

June 21, 2007 ------ EAD email from Cris, USCIS has sent notice on the mail that EAD is approved

June 23, 2007 ------ EAD card received in the mail

July 11, 2007 ------- Initial interview ( Denver, CO ) approved- Thank God

July 17, 2007 ------- Received Welcome Notice in the mail

July 18, 2007 ------- Email Notice from Cris " Production of Card Ordered"

July 27, 2007 ------- Green Card received- God is so Good!

Yes. The cosponsor fills out the I-864A. The sponsor and cosponsor both have to sign it.

Also, dont forget that the sponsor also has to fill out the I-864, even if they have no income.

2/23/07 - Mailed AOS packet to Chicago

2/25/07 - Package arrived in Chicago

3/05/07 - Checks cashed

3/05/07 - Received NOAs for I-765, I-485, & I-130!

3/09/07 - All touched

3/10/07 - Received biometrics appt letter

3/12/07 - All touched

3/13/07 - I-130 & I-765 touched

3/15/07 - I-485 touched

3/15/07 - Received email informing me that an RFE has been mailed to me about the I-485

3/19/07 - Received RFE for I-485 in the mail.

3/20/07 - Biometrics appt

3/21/07 - I-485 & I-765 touched

3/23/07 - Mailed back RFE with signature confirmation

3/26/07 - RFE was delivered to Lee's Summit, MO & was signed for by "Ashley Love"

3/27/07 - Received email saying that RFE has been received at MSC and that case processing has resumed

3/27/07 - I-485 touched

3/28/07 - I-485 touched

4/17/07 - I-765 & I-130 touched

4/18/07 - All touched

A co-sponsor uses I-864.

I-864A is "Contract Between Sponsor and Household Member".

So I'm afraid elgringo is wrong here.

I sent in all my paperwork in Feb and my cosponsor filled out the I-864A and I filled out the I-864. USCIS didnt say anything about it being wrong, which leads me to believe I did the correct thing......

Quite possibly you did do the correct thing - you just don't know how to explain yourself correctly.

If you used a Household Member's financial resources to supplement your own, you did the right thing. If you did not use a Household Member, the USCIS has simply not assigned your file to a case officer yet, and when they do you'll be getting an RFE.

The OP's co-sponsor doesn't live with them, so needs to file I-864. If your cosponsor doesn't live with you, then you did the wrong thing.
