E-mailed Montreal re: RCMP 120+ days wait

Isn't this a bit strange? I sent an e-mail to Montreal with the following:

I have requested an update on my request for a criminal background check with the RCMP, and I received a reply stating that my request was entered I their system on February 18, 2007, and it will take 120 plus days to process my request. The 120 plus days could run from May 20th to July 20th depending on whether they count 5 or 7 days as workdays. Our visa process is valid until April 7th, with the 4-month extension permitted by the consulate I would have until the 7th of August to have everything finalized and I was wondering:

1. Does the interview have to be done on or before the 7th of August deadline?

2. Could the checklist be sent to the consulate before the RCMP documentation is in my hands and check it as having been received?

3. I have a letter from the court where I was arraigned is it necessary to also have a statement from the arresting police force also which was a RCMP detachment?

For number 1 there was no reply.

For number 2 there was no reply, but I do know that the answer is yes.

For number 3 there was no answer, the answer should have been yes as per packet 3.

Below is the reply I received from them.

I have entered you as having all docs recd; the police certificate does not have to be taken with fingerprints unless you have had problems with the law.

I find that someone took the initiative and jumped the gun without all the facts by assuming I have everything in hand when in fact I don't as yet. I will be getting the documents from Sharon in a few days they are not here with me.

I am left wondering if what they did is what is done when the checklist is sent to them. Should I at this point consider myself as checked in (having sent the checklist) and waiting for a interview date.

10/02/2006 - NOA 1 (I-797C recieved in the mail)

12/26/2006 - Package recieved by NVC

12/30/2006 - Received by Montreal

01/22/2007 - Received Packet 3

04/16/2007 - Returned Packet 3

08/02/2007 - Received medical documentation

08/07/2007 - Received Interview date Aug. 9th

08/09/2007 - Received I-601 and 212 (not approved yet)

02/17/2008 - I-601 approved 212 abandoned

06/2?/2009 - New medical and passport and doc sent to Mtl

07/22/2009 - Recieved request for DS-221 and notarized letter of intent

07/31/2009 - Montreal recieves thier final requested doc.

09/01/2009 - Visa approved and mail out today

It sure sounds like they have put a little check in the box next to "sent checklist back" for you, but really, I would not take this for granted. Send the checklist in yourself for sure!

Mar 17 - got email, attached to one case number only, saying that my A number was changed relating to the I-130 filing

It sure reads as though they have documented you as having sent in the checklist. If it were me, I would send the checklist in anyway with a note and maybe a copy of the email response you received.

In the case of sending the checklist back , most of us ( to my knowledge anyway) have returned the checklist not having all the items required in our possession, without issue.

If in your case a police background check is required with fingerprints and the report does not arrive in your hands by the time an interview is scheduled, I would assume you could simply request a later date. With Montreal being historically slow in scheduling interviews, the likelihood of you receiving an interview within the 4 month vaildity date of the NOA2 is low. It seems as tho a large number of us have gone outside of those dates, again without issue.

Another option that i think is worth consideration is to allow an interview to be scheduled which you will attend. If you lack important evidence at the time of the interview, you should be allowed to return that information after your interview, at which time the visa should be issued, barring any other complications. That idea is a work in progress in my mind so it would be nice if others weigh in on the pros and cons.

I hope I didnt miss the mark here and understood your concerns.

As usual Cuienpurgy's response has left me dumbfounded,lol Who was it on VJ that was scheduled for an interview, then had to delay it becuase she had a baby? Was suppose to be just prior to Xmas, and she still has not had the interview. Almost appears Mtl puts one back at the bottom if you have to reschedule!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Mo. I think it is about time the list was sent in even though I would have prefered to have everything in my hands except the police report which will be here in its own time.

CutienPurg, you were right on the money with your reply. My concern is that we have with the extension until August 7 with no further extensions avaiable and I was wondering if they had everything they asked for would an over run past August 7 would be available is necessary.

flames9, I will take the bottom of the list if necessary if it gets me to Kansas without going through the while process again. If it is necessary to start over we have another option open to us, Sharon could come here, the only thing that really matters is that we are together the where is of no consequence and never was.

Still we are keeping all options open.
