Both I130 and I129f have been approved on December 1st and we sent out I-824 on December 5th (Application for Action on an Approved Application or Petition) and we havent heard anything from nvc or uscis yet. Does anybody know anything about the process? How long usually takes for us to be notified by nvc?

K3 VISA:

09/20/06 - I-130 Sent

10/03/06 - I-129F sent.

10/10/06- I-129F NOA1

11/28/06 - BOTH I-129F & I-130 approved!!!!

12/27/06 - NVC Left case no. assigned MNL 200685XXXX

01/26/07 - Received Packet 3

02/27/07 - Received Packet 4

03/01-02/07 - Done with my Medical Appointment at St. Lukes

04/17/07 - Interview at U.S Embassy - got the blue slip..on AR

07/05/07 - Went back to US Embassy submitted new affidavit of support for my K3, we'll wait for decision, still on AR

07/24/07 - OMG!!!! I cant believe it I got my K3 Visa in hand!!!

08/09/07 - Arrival in the U.S - POE at LAX

AOS:

08/27/07 - Sent AOS and EAD

08/29/07 - Chicago Lockbox received both AOS and EAD

09/18/07 - Checks cashed 09/21/07 - NOA on both AOS and EAD

09/27/07 - Received Biometrics Appointment Notice

10/18/07 - Biometrics

10/19/07 - Received RFE

10/26/07 - USCIS received the response to our RFE

11/05/07 - EAD Card Production ordered

You should get something from the NVC with regard to the immigrant visa several weeks to a month or so after they receive the approved I-130 petition from the USCIS. By then the approved I-129f petition should already be at the consular section in Manilla and your K3 visa application in progress.

Are you planning to return to the Philippines for the immigrant visa rather than adjust status from K3 here in the USA?

It seems to be normal for it to take several weeks for the approved I129F to get to NVC. You can call NVC to check if they have received it.

I am also curious regarding your filing the I824 - did your I130 NOA2 indicate that it was being retained? It would only be necessary to file the I824 if you hope to interview for the CR1 in the Phillipines.

I am going to add you to the Tracking Approved I130s thread in the I130 forum. Not many people have had to file the I824 yet, so we really don't know how long it takes.

thanks for all infos.. We called NVC and said that they already got the NOA1 form for I824, and that's all we've got as of now

Going by the processing dates on the USCIS site, it is showing up to 6 months for the I-824, just as it does for petitions. As yodrak asked, are you intending to return to the Philippines for the CR-1, as opposed to adjusting status in the US from the K-3?

The USCIS made a mistake & thought Anneiy is in the States already and states that Anneiy can either adjust status at the local INS office or notify USCIS if not. Jacky also called the USCIS customer svcs and informed them the mistake. AND THE AGENT WHO ANSWERED THE PHONE SAID THAT I (JACKY) CAN FAX OR WRITE TO THEM TO INDICATE THE MISTAKE & FILE THE I-824 AT THE SAME TIME TO TELL THEM (uscis) WHAT WE WANT THEM TO DO NEXT. So Jacky did write to them regarding the mistake & filed I-824 and have already got the receipt (NOA ).

I guess what the USCIS agent said was misleading. I just spent $200 dollars for I-824 which most people did not have to. On the I-824, I chose the option "forward the approved petition to NVC."

We spend most attention on pursuing i-129F so we forgot some progress and thought I-130 should also be forwarded from USCIS to NVC just like I-129F.

You need to notify in writing that you will be adjusting status in the US from the K-3. Hopefully this error can be corrected prior to the service center forwarding the I-130 to NVC.

Not exactly a mistake, but certainly confusing to you unless you have developed a good sense of things. The USCIS is using an existing notice, that is applicable if not clear, because it knows that you have embarked on the K3 visa route and that Anneiy will be in the USA as a K3 if you continue on that route as most people do.

The approved I-130 should only be sent to the NVC if Anneiy wants to pursue an immigrant visa, either instead of or after receiving her K3 visa. Otherwise, the USCIS needs the approved petition and the DoS has no need for it.

Perhaps your unfortunate example will help others to understand a bit better and save them some unnecessary expense.

I'm not convinced this is either a mistake or unfortunate. It's something I've been contemplating... I just don't have the approvals yet, so I haven't had to make the decision (gamble) :)

If it's taking 4 to 5 months to get a "K" visa interview at the Manila embassy, isn't it possible the IR1/CR1 could catch up, especially if some of the shortcuts are used to help speed up the documents at the NVC? What happens if the embassy receives the CR1 before the K3 interview takes place, and the K3 interview has already been scheduled? Is the CR1 interview given at the K3's scheduled time? If the K3 has not been scheduled, does the CR1 just "overtake" the K3? Except for the extra $200, has the I-824 changed any of the assumptions of the past that it was often a good thing to have both visa applications proceed to the embassy?

It's a little unclear to me in looking at the timelines for people who have both the I129f and I130 approved, which visa they were interviewed for, and which one did they receive. I know it's difficult to include EVERYTHING on the tables.
