Please i need your help.

My bf apply a k1 for me, but he applied another person on 2004 and now he apply for me on 2006. But USCIS wants to deny us because he applied 2 k1 in two years. They request a waiver within 30 days. But he does not know how to request a waiver.

Does anybody know a similar case? Please help us! I don't want they deny us. :help:

My K1 journey:

Aug-02-2006: I-129F sent

Aug-14-2006: Cali service center received

Aug-15-2006: NOA1 (14 days)

Oct-23-2006: touched the 1st time.

Oct-24-2006: touched

Oct-25-2006: touched

Oct-31-2006: Email notification of RFE

Nov-17-2006: IMBRA sent to CSC

Nov-21-2006: touched ------- CSC received IMBRA

Nov-22-2006: touched

Nov-27-2006: touched

Nov-28-2006: NOA2 (118 days)

Nov-29-2006: touched

Dec-06-2006: received approved letter by mail

Dec-14-2006: NVC received

If I were in this spot, I would consult with several different lawyers who have immigration experience. I am not saying that he should necessarily hire one, just have an initial consultation to determine if he should hire a lawyer.

Our Timeline

08/03/06 -- Met online, have chatted almost every day since then

09/29/06 -- Met in person at the Lima Airport. 10 wonderful days together.

10/31/06 -- I-129F mailed to TSC

11/09/06 -- CSC cashes the check

11/14/06 -- NOA-1 Received

11/16/06 -- We get 11 days together in Arequipa (Betty's home town). I meet her family for the first time.

12/28/06 -- We get 19 days together in Arequipa. I'll be back in February.

01/18/07 -- Touched! First sign of life.

01/19/07 -- 12:10 AM, NOA-2! APPROVED!!!!!!!!!!!!! On to the next step.

01/19/07 -- Touched again, around 11 AM. I guess we're on the way to the NVC!!

I am not an expert, but I don't think he needs any sort of special form. He simply needs to write a letter asking for a waiver, explaining why he is now filing for a new K-1 for you, and what happened with the other person for whom he filed the earlier K-1.

You may get better answers from others on here, but it is not the end of the world. Good luck on your journey!

  • October 13, 2006 NOA2! November 2, 2006 NOA2? Huh? NVC already processed and sent us on to Abu Dhabi Consulate!
  • February 12, 2007 Abu Dhabi Interview SUCCESS!!! February 14 Visa in hand!
  • March 6, 2007 she is here!
  • MARCH 14, 2007 WE ARE MARRIED!!!
  • May 5, 2007 Sent AOS/EAD packet
  • May 11, 2007 NOA1 AOS/EAD
  • June 7, 2007 Biometrics appointment
  • June 8, 2007 first post biometrics touch, June 11, next touch...
  • August 1, 2007 AOS Interview! APPROVED!! EAD APPROVED TOO...
  • August 6, 2007 EAD card and Welcome Letter received!
  • August 13, 2007 GREEN CARD received!!! 375 days since mailing the I-129F!

You can try reading through that thread or message the person who started that thread because he was approved with a waiver.

As far as I understand it, your fiance would have to explain why he should not have to wait 2 years before applying for another K-1. He probably should consult an immigration attorney with this question, however, since he's been denied, all he can do is file the waiver.

I also believe that a waiver is just a term for "letter of explanation". He needs to write a letter explaining about his first relationship, probably pointing out that he entered into it in good faith and then explaining what went wrong and then why he is applying for you. I don't think they are denying you over this, they are probably just asking for a little more paperwork. Maybe it is not time to worry yet.

read articles about IMBRA also...i remember that there would be no multiple marriage of foreign women with this new law...well, he hasnt married the previous girl, has he?

This is correct and it's all he needs to do. It's all there on the I-129F instructions. He needs to start by reading those and then write the waiver within 30 days. A consult with an attorney experienced with multiple I-129Fs post-IMBRA wouldn't hurt.
