HELP...

Below is an email that I have passed on to a few of our Phil-Am families that have recently received their NOA2s. Do you think it's way off base? What could be added to improve this information?

(1). The National Visa Center (NVC) number is within my signature. NVC assigns your case number once your case is approved (NOA2). They also may perform a preliminary background check from what I’ve read then forwards your package/case to the Manila Embassy. This process usually takes anywhere from 14 – 30 days.

(2). Packet 4 (Manila Embassy) link is within my signature (acquired from the Manila Embassy website which gives directions on what documents are required by the beneficiary for the visa interview). The Manila Embassy number is within my signature. NOTE: If you dial 0 for the operator, ask for the Immigrant Visa Unit. The average interview is assigned approximately 120 – 150 days from the receipt of your package from the NVC.

(3).The Department of State (DOS) number is within my signature. After your case is approved (NOA2) and reaches the Manila Embassy, you may call DOS instead on the Manila Embassy to obtain status of your case and make inquiries concerning your interview date. NOTE: DOS has no direct participation in the K1 process.

(4). St. Luke’s Extension Clinic (SLEC) information is within my signature. SLEC is where the beneficiary goes to take the medical exam and vaccination. The process takes two days. Day 1 is the medical exam and Day 2 is the vaccination.

(5). The I-94 Arrival / Departure Form is within my signature. Foreigners (beneficiaries) complete the I-94 and the Customs and Border Protection (CBP) officer stamps the applicant’s arrival and departure portions at the Port of Entry (POE) when entering the States. You will need this for the Adjustment of Status process.

120 days? we were informed by the NVC last may that the documents that we submitted for the instruction packet were already complete and our documents were being forwarded to manila, until now i havnt received any packet 4 or whatever letter from the embassy, i just called manila embassy this morning and said that my case number is not included for the october schedule of appoinments and she told me to call back next month. its been more than 120 days!

Storm, Day 1 of the 120 day wait starts on the day the embassy receives your "physical file". When NVC says "your file has been transferred to embassy", it usually means "electronic transfer" and we don't count electronic transfer as Day 1.

You need to call the embassy to know the exact date that they physically received your case file and only then can you start counting 120 days to guesstimate your interview date.

You don't! Visa interview dates are assigned to beneficiaries of K1 petitions, and the current wait time is approximately 120 - 150 days from the receipt of your package by the USE from NVC. Mabuhay!

Is the consulate awake yet? I have to wonder just what they have been doing the last 2 weeks without any scheduled cases for interview because of IMBRA. Must be some fiesta.

In other words, I fail to see how it's possible people are scheduled for interviews that have timelines after the IMBRA deadline and closer to the present than mine. There can't be too many.

"Per Republic Act 8239 and Department of Foreign Affairs (DFA) Order 28-94, Filipinos proceeding abroad as fiancé(e)s and spouses of foreign nationals are required to attend the CFO's guidance and counseling programs... " For more info (CLICK HERE). NOTE: As far as I know, this requirement is not stated within the K1 packet. However, the beneficiary can NOT travel without receiving the Guidance and Counseling Certificate and subsequent CFO stamp on the visa.

(6). The I-94 Arrival / Departure Form is within my signature. Foreigners (beneficiaries) complete the I-94 and the Customs and Border Protection (CBP) officer stamps the applicant’s arrival and departure portions at the Port of Entry (POE) when entering the States. They are sippin margaritas on the beach watching the sunset. We are going on a month and a half of waiting for an interview date to be assigned. If I'm not mistakened, USE does not set the interview dates for K1s. At any rate, we are on ice until somebody gets on the ball. Pick up a hobby. LOL!!!

I say 2 weeks because the last interview scheduled on the last update to the interview list was Aug 30th. While my timeline isn't up anymore I've been waiting since this all started. We were supposed to have our interview Aug 23rd originaly.

One other thing that this all brings up. Us IMBRA people, do you think we will still have to wait another 120-150 days before they schedule a date from when they recieved it from the NVC a second time? Could that be why it seems no activity?

If not, should my fiance be in Manila right now to do her medical and wait for the interview just in case they suddenly schedule us for 2 or 3 weeks after they finally let us know of the final interview date? She would be flying in from the visayas (bohol by tag city)

That is a very good question. I don't know the answer, but for some odd reason I'm thinking they will put you poor souls back on the waiting list. Just because this process sucks, and nobody really gives a dahamn! Please call the Manila Embassy and inquire because I'm very interested in their response. I still have to follow up on whether interview dates are schedule a maximum of 90 days out, which could be the rational for the prolonged period of inactivity as far as assigning interview dates. Cheers!!!

It seems the USCIS, the NVC and the Embassy have all gone to "batch processing". There is no activity for a while, then "boom" - we see a flury of activity. Then silence again until the next batch. Maybe we will all see interview dates when the next batch processes. Maybe all the batch processing is based on the USCIS and then has a domino effect.

I had hoped to get married on Christmas Day but am soon ditching that idea with no interview date yet. While I now expect my process to reach 11 months, I know some who have waited much longer, but then again so many somehow sneaked past us in the queue.
