Hope you get a speedy return. Proof of being a student? That's a new one.

Yeah I was surprised the consulate asked for that also. Nothing I've read says that the petitioner needs to prove he is a student. I can understand proving the petitioner's employment, but going to school is not employment. But then again, arguing this point with the consulate is useless. At least the consulate's request is fairly simple to fulfill, unlike others who had their relationship questioned and made to prove every details of their relationship.

Every questions they asked I had practiced with my wife. So my wife knew the exact answers and I think this convinced the CO of our relationship since he didn't ask to see a lot of evidence.

I wrote up the interview with the hope that those in similar situations know what they need when going through the HCMC consulate.

Another one they like to ask the fiances is the address of an ex-spouse. Reading VJ had us prepared for this question-not something on the checklist. Until this day I have no idea what they do with that information. My ex-wife never received a knock on the door or a phone call from an immigration official. Can you imagine if you had to use your ex-wife to vouch for your ability to sponsor a new wife from another country?

Yeah, I knew about this, but since it was the first marriage for my wife and I, I didn't need this information. I think they ask for ex-spouse information because they want to know if the petitioner had sponsored the former spouse, then divorced her to sponsor another. They are afraid of marriage for immigration purposes.

My wife told me that most marriage based beneficiaries who interviewed before her left with 221g blue slips. The only ones who passed were family based beneficiaries. I believe HCMC is just stalling for time with nonsensical requests when they couldn't find any fault with the relationship or petition. My petition was very straight forward and I had a lot of relationship evidence and my wife knew all the answers to their questions. So I can't think of a reason for them to delay the visa.

As a warning to any student petitioner or beneficiary going through HCMC, be prepared to show proof of academic enrollment.

Wow. I am reading this and realize my fiancee and I are going to have to go through this, as she lives in Ho Chi Minh City. :(

Is there any real reason why they are shooting down visas for couples who are clearly not fraudlulent? What's the purpose? I know many Vietnamese men hate it when foreigners, especially white foreigners, marry Vietnamese women. This isn't conjecture. It's fact and every Vietnamese person I know says it is true. So maybe that has something to do with what goes in with this process in HCMC?

I worry about HCMC trying to contact my ex-wife. I have ZERO desire for my ex to know my business. I do not want her know I am getting married. It's none of her damn business! :protest:

I also need to worry about my work situation. Right now I am self employed, working as a writer and making money strictly under the table. In addition, I have been caring for my grandmother, who has Alzheimer's, so I am a caregiver, but not officialy. How how do I handle that?

Just get me to May. I'm going to Veitnam for two weeks to be with my girl and I cannot fricken wait!! :dance:

Yet just recently "Cousin #2" was granted a visa to one less than satisfied Nate, despite there being a language barrier and a tie to the benificiaries family at his home.

This is going to be a problem for you. You have to prove that you meet the minimum poverty level. This includes tax forms, letters from employers for most of us, and letters from banks. This will be checked- just ask scy. If you don't think you're going to be able to provide this proof, you should consider trying to find a co-sponsor.

I already found a co-sponsor (my parents are happy to do it). But when do I start that process? I read conflicting opinions. How do I handle this?

I have a huge paycheck coming to me later this year, but her interview will certainly come before that, so that does not help at all. The life of a writer is long periods of stravation followed by one day of getting paid, followed by making that money last a long time. ;)

Don't be so confident about her interview date! You haven't even gotten NOA2 yet. This is HCMC you are going through so it could be quite a ways off. Anyhow, income information comes when the consulate sends your fiance "pack 3". You and your co-sponsor have to fill out Form I-134.

I have posted this in the old thread but since I found this is the new one, I just want to make sure.. sorry.

As I have a post here http://www.visajourney.com/forums/index.php?showtopic=151433, I just found out that HCMC is very strict on co-sponsor thing. But I can show that I'm a fully time student, therefore cannot make sufficient income to meet the poverty guidelines.

I need help, there is no way for me to make such money, but I can clearly show that I am fully able to support her when I'm out of college. and there is no way for me to do the K3 since I'm not even 20 years old yet. co-sponsor would not be a problem if I asked my uncle and aunts, who own their own super market and their million dollars houses. Please help me with this step at the HCMC. I want to prepare everything and not have to deal with it blindly later.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
