Nik+Heather,

This is the text from the RFE we sent in the mail. The first paragraphs are all the standard stuff so I will put what they have by the box with the x in it.

You have indicated that you last entered the U.S. as a K or V non-immigrant. Please submit a properly completed and signed copy of the medical exam conducted overseas on Form DS-2053, Medical Examination for Immigrant or Refugee Applicant, for the applicant on Form I-485.

If you do not have a completed Form DS-2053 please submit a properly completed and singed Form I-693, Report of Medical Examination and Vaccination Record for the applicant on Form I-485. The medical examination must be conducted by a civil surgeon who has been designated by the USCIS and must be issued within one year of filing Form-I485

Then it goes on to numbers to call and other info but I think the most important stuff is above. Like I said in a previous post we submitted the for I-693 completed with only immunizations by a civil surgeon and sent the DS3025 along with it. Please let me know what i can do. Thanks.

Interesting. Mine didn't have the stuff about a DS-2053. It just said to submit a properly completed & signed Form I-693.

Good luck finding someone who charges a reasonable amount! We paid $150, which I would've thought was quite high until I read what some doctors charged.

Yes, I'm hoping and praying it'll just be $150 because from what I've read on here it can certainly be outrageous!

I tried to reply from my phone while you were online, but the posts just wouldn't show up for some reason.

Anyway, I think you should at least give the congressman/senator inquiry a try. It's free, and it can't hurt. If they think that you are supposed to send it in to you, then they might not have even looked for it beyond your AOS filing. For us it only took a week to get an answer back, and that's not too long if it can help you and save you some dough. They might come back and say "sorry, it's lost" and then you're right back where you are now, but they also might come back and say they found it. They have access to a level of service within the USCIS that we will NEVER get to.

This solution doesn't seem to be widely advertised on VJ, and the immigration specialist you speak to will hopefully have some knowledge of other people's cases to help you out. All you have to do is google their names and go to their website - under constituent services you can get their contact info and also find their privacy forms. Give them a call, and when you find the one who seems the most likely to do you some good, mail, fax or hand carry the privacy form + a letter requesting they look into your case to their office & wait for a response. I would suggest calling before writing - just in case there are slight differences in their procedure than the one we went through.

Thank you so much. I will try that. I already looked online and found the privacy forms for our senator that you suggested. I hope this will work. Again, thank you.

We decided to try this as well since we can't seem to get an answer from USCIS as to whether they actually did lose the medical or not. We have an infopass appt for Feb 3. We wrote a letter tonight and will mail it tomorrow. Like you said, it doesn't cost anything and it might help us.

Well, as the guy at the national benefits center mentioned that Nik's EAD is just waiting on biometrics, Nik is going to try to do a walk in today, now that we've gotten the notice in Saturday's mail. It's only a week early, but from what I understand, the EAD is only 2-3 weeks past that, so it's a big portion of the remaining wait time.

Well we are two weeks past biometrics...and nothing happening yet. :crying: Hopefully we hear something this week. Hope you do as well.

Successful walk-in completed today. At least I can feel like we have been doing our part to keep this filing rolling along.

Congratulations!

Guys, I'm kind of freaking out (probably over nothing). I just realized that I may have done something very stupid. A few weeks ago, I had to change my insurance for this year (money is tight with my husband not working and we've had a few unexpected medical expenses). Anyway, my insurance no longer covered birth control, and my doctor mentioned that I probably qualified for a discount because I'm young and our household income was low. I didn't even think about it. I won't do it again, obviously, but now I'm worried that this will not look good for AOS

Good afternoon.

I just wanted to say hi since I've been reading quite some posts over the last two months and also did some "benchmarking" by looking at some of your timelines...

My case got sent to the government on 12/21 and I was already getting worried that my bio appointment notice could have gotten lost but it finally arrived today. Seems like mine was more on the slow end compared to some of the other cases here.

No questions at this point, I just wanted to contribute some more data points to the group.

AOS Timeline:

(in the US since Aug 02, starting on J-1, currently on H-1B)

Sep 4, 2009: US wedding (legal wedding date)

Sep 25, 2009: church wedding in Germany

Dec 21, 2009: case sent to government

Dec 22, 2009: government receipt date

Dec 31, 2009: I-130, I-131, I-485, I-765 touched

Jan 3, 2010: NOAs received for I-130, I-131, I-485, I-765 (all dated 12/28/2009), received two copies of each NOA...

Jan 14, 2010: I-130, I-131, I-765 touched

Jan 25, 2010: Biometrics appointment NOA received (dated 1/14/2010) for 02/09/2010

Jan 27, 2010: Biometrics completed at the Detroit ASC (walk-in)

Jan 28, 2010: I-485, I765 touched

Feb 13, 2010: Interview NOA received (dated 2/9/2010) for interview on 3/25/2010 @ Detroit USCIS

Feb 19, 2010: Second interview NOA received (dated 2/16/2010) for interview on 3/31/2010 @ USCIS Detroit

Feb 22, 2010: called USCIS to ask about duplicate NOA, got confirmation that system shows interview date of 3/25

Feb 25, 2010: my firm's immigration law department informed me about a memo they received from USCIS stating that there were problems with duplicate interview appointments

Feb 26, 2010: received letter from USCIS about erroneous interview notice and clarification about correct interview date: 3/25/10

I'm not sure why that would be bad at all, really...This process can make a person paranoid, can't it!

Anyway, Just last week I was amazed at the incompetence of it all, and now I'm amazed at the speed - I'm going to have to keep TIMES in my timeline....

11am: Nik completes walk in biometrics.

1:45pm: Case status email - EAD (and AP) are now in document production phase. (WOWZER!!)
