well my case and my two childrens case is now complete at NVC

which is good news

bad news is NVC told me yesterday jan 19 2010 that they have already sent out files for feb appointments no more will be going out till march due to back log in montreal

their not even sending completed cases due to fact they might get loss due to over logged in montreal

sad news :crying:

if anyone has any comments on what i should gather for my appointment when ever it will be please feel free to give input.

was really hoping to be living with my hubby for our first year anniversary feb 23 :crying:

this is a very hard process and i just live a hour from border gosh so complicated

Yes, it's too bad they take so long to schedule interviews, hard for everyone involved.

Actually, files are not sent to Montreal immediately anyway, they are sent around 2 weeks before the interview date (from NVC) - so maybe the operator was just confused. Or maybe it's because they have always been backlogged.

Montreal does not and has never scheduled for the next month. I can't view your timeline right now because it won't display for me, but if you just completed NVC you won't see an interview for a few months - unless by some miracle they catch up.

The only way they send cases to Montreal to be scheduled is if they are expedited, then Montreal sets up the appointment. As far as Paper work make sure that you have all proof FULL custody saying the children are legally able to move to the US. If you were never married previous bring what is called a CERTIFICATE OF NON MARRIAGE. Can get from vital stats building in manitoba and has to be from the province that you live in cost 25 dollars if you can pick it up directly, 60 if you want it expedited. Or The easiest way is getting a notorized letter from the childrens father saying it is ok for them to move to the US.

this is all gee whiz information in case you didnt know. if you did then disregard. I would also get any vaccinations you can for yourself and children before the medical appt. it will be alot cheaper. If your spouse is military and you are on his medical you can get them all for free if you can get to a base in the US. anyway if you have any questions feel free to ask just went thru the interview early this month really easy no problems other than that proof of non marriage for wife. but other than that was easy.

Yeah, the waiting does suck and Montreal's very slow. IF I were you, since you just finished your case this month, I'd mentally prepare yourself for a 3-5 month wait. I know, it sounds horrible but if you spend a lot of time thinking, we're next, you'll spend a lot of time being disappointed. I hope MOntreal picks it up but it may not be the case for awhile.

Your case will only get sent to Montreal once you've been scheduled and that's it -- otherwise it's at NVC.

I'd prep for the med stuff for you and the kids, make sure you have all your letters and such, proof of marriage and just keep yourself busy with kids/work and whatever in the meantime.

Who needs this certificate of non marriage? Im an american citizin living in the US and my husband lives in Montreal will he need this? His interview is next month and I want to have everything I need.

No offense, but this would appear to be misinformation.

You DO NOT NEED any certificate of non-marriage in a CR-1 interview. In all the cases I have heard about on VJ over the past several months, I have never heard this document mentioned.

I got the impression the Certificate of Non-Marriage was only mentioned because the OP has children and needs to prove they can legally move to the U.S. If the OP was never married, that seems like one way to do it.

Doesn't matter whether she was married to the childrens father or not. Just showing she was never married would not give you permission to move the children without the father's permission.

Wife was born and raised in manitoba.

To answer all the question basically put... Mine was a case where the father was on the stepchilds birth certificate but never married... And there were no knowledge of his whereabouts. because the law in manitoba states that if the child only lived with one parent and they never lived together and were never married the parent that the child lives with has custody. also if there are no child support or any court order for visitation rights. We showed them the law stating such and even had a notorized letter stating the same and that the mother had custody. But the interviewer wanted proof that there was no marriage but because there was no marriage there was no way to get a divorce decree.. so the only way that we could show proof was to get a Certificate of NON-Marriage in manitoba. Yes, you can use a notorized letter from both parents but that wasnt our case.. and to save time with the courts this was the easiest way... So no this is not "MIS-INFORMATION" this is directly from the embassy mouth on what they wanted for proof. Im just trying to give information on what was needed and its easy to get a certificate of non marriage if there was never a marriage to begin with.

I assume rules are different in the U.S. and Canada, but some of the situations are the same, so they have to modify what's necessary for proof based on the siuation, like in the person who's posted above case. I'm the USC and I also have a daughter. I've never been married and my daughters father is not part of her life. Never has been. He lives in the same ciy, but I wouldn't know where to find him. When I applied for her passport I was required to show up at the appointment with him or to obtian a notarized letter from him stating he gave permission for her to obtain a passport, which gives permission for her to leave the country. Well, I wouldn't know how to find him, and even if I could, we aren't exactly on good terms. So in lieu of him being present or signing a statement, I needed to attach and complete a Special Circumstances form. I ended up getting her passport 2 weeks later with no problems. My point is, there aren't any cookie cutter cases when children are involved. I agree there was a lack of information present to provide the best response possible, but I don't think posters should be treated like idiots for giving their opinions that may be based on their experiences.

I don't think anyone said the poster was an idiot. All people said was they had never heard of anyone in Canada needing a certificate of non marriage before from Canada and asked for more details on why this ONE case did need it. The reply will certainly help those with the same circumstance now that more details have been provided.

The problem is that the poster said it rather emphatically, as if the OP would HAVE to bring a Certificate of Non Marriage to the interview...and that's clearly not the case. In other words, the poster did indeed give misinformation as it pertains to the original post. As you said, there aren't any cookie cutter cases, so a cookie cutter response like, "You need to bring a Certificate of Non Marriage" doesn't really apply, does it?
