Hello All,

First off, I have read through many posts and the help pages on AOS, EAD etc. I am new to the forum this is my first post. I am still trying to learn the acronyms and abbreviations used. I am also not an instant message or text kind of guy.

Questions 1) Can I file for AOS the day after I get married and must I wait until that time?

Question 2) I looked at the time line chart through the link. Many lines give a period of time 1 month/ 2 months etc. For the AOS of alien spouse the timeline lists a date in the past. The footnote states if a particular date is listed, this is the last time such a product was processed. It doesn't make sense. If it is true am I to believe the last time someone received an AOS through the Vermont office was in 2007? The list was updated Jan 15, 2010

Please fill me in on when is the best time to apply for AOS. From what I have read there is another bout of giving proof. How can one attain such documentation in the short period of time you are together if marrying on a K-1?

What is the real timeline for getting AOS finalized? Would it be beneficial to apply for EAD as soon as possible - assuming she can get SS number right away. It just doesn't make sense that one must apply for AOS and in such a short time give proof of relationship when it is difficult to attain this in such a short period of time. Thanks - sorry if this was disjointed. :wacko:

1) Since a certificate of marriage is required for AOS... you must first be married

2) VSC does not list a processing time for an I-485 other than employment based

3) File for AOS as soon afgter your marriage as you are able.... Proof of relationship is not required with the I-485 initial filing

You can file for AOS as soon as You can receive a certified copy of the finished marriage certificate. And from what i have read it normally takes about 3 to 6 months for an AOS. And the sooner you apply for a EAD the sooner you get approve but also from what i have read they will get approved about the same time.

To speed up when you can file, I recommend asking for a certified copy of your marriage license the day you get married, instead of waiting for them to send you the original.

I'm glad I did that, as I got married almost 2 months ago and still haven't received the original. Matter of fact, I need to call them about that...

As far as applying for EAD, there is no fee for that IF you apply for it concurrently with the AOS. If you want to apply for any reason before you send in your AOS stuff, the fee is $340. Most people find it makes more sense to just send everything together. Most people seem to be getting approved in a matter of a few months.

As far as proof of relationship, USCIS knows that you haven't been married that long. They do take that into consideration. Get your wife an SS number ASAP so you can add her to your bank accounts and things like that.

I think most people only include one thing for "proof of relationship" when filing AOS: the marriage certificate.

If you get selected for an interview, you'll need to show proof then.

November 19, 2007 - Met
