Hello there everyone.

I just got a mail from Social security administration saying for my wife:

We cannot give you a social security card at this time because:

your legal immigration statusand/or documents will expire before an SSN card can be issued to you.

Please contact us when:

you cangive us the document we need.

What the hell, when i was there we provided them her K1 visa which will expire on December 16th., marriage certificate.

Last week we got on mail the notifications from USCIS that they got the forms from us for I 418, I 131, and others.

What do we do now???

-February 17th, 2009 I-129F application sent

-February 19th, 2009 I-129F arrived in Vermont

-February 26th, 2009 received NOA1

-June 30th, 2009 NOA2 approved

-July 29, 2009 Medical exam passed

-September 3, 2009 Interview passed!!!

You might want to take a look at this portion of the FAQ: http://www.visajourney.com/forums/index.ph...om&page=ssn

It says, "As a K-1 Visa Holder you are eligible to receive a SSN upon producing a valid I-94 (unexpired). Do not wait until you only have a few weeks left until your I-94 expires to file for a SSN. Many SSA offices will not allow you to file for a SSN if your I-94 is about to expire (generally 14 days prior to the expiration on your I-94)."

So, unfortunately the SSN office may very well be correct. This has happened to a number of people who have waited to apply for their SSN's and came to close to their I-94 expiration dates. It seems as though you'll need to wait until you can produce an EAD or GC.

Actually we applied for SSN on October 2nd, then on November 6 they called us to go back and give them the documents again about I -94, because she forgot to copy all of them...How can they do this??? its more than a month since we last went in there!!!

This is irritating me

SSA will not assign an SSN or issue a card when an applicant's immigration status is within 14 days of expiring. For a K-1 it's 14 days before the K-1 status expires based on the date of entry on the Form I-94, not when the visa expires. K-1 status is good for 90 days, so that makes a K-1 eligible until they have been in the U.S. 76 days.

The timeline isn't filled out, so I still don't know when the I-94 expired.

Even if the I-94 wasn't expired when the application was filed, sounds like it was by the time the SSA office got the paperwork correct. If you enter that 14 day period before the application is cleared you are out of luck no matter how many days before it you applied.
