Joint sponsor paperwork can get a bit tricky for married people. The way you avoid an I-864 from the joint-filing spouse is to state only the sponsor's personal income instead of the total joint income from the tax return and back that up with supporting documentation that clearly indicates the stated income is that of the sponsor, not the couple. Depending on the sources of the income, that's not always possible. If the joint sponsor is elderly, they may insist on the I-864a anyway.

I'm curious. Pushbrk -- I'm following your instructions with regards to the joint sponsor I864, but I'm also getting a I864A. Just as a back-up. Do I still need the supporting documents from the spouse's side (employment letter, paystubs etc) even the joint sponsor's individual income/assets are way above the required lines?

Or is the I864A just enough to show the spouse's awareness/acknowledgement?

As far as I know, if the two I-864's are done correctly, there's no need for an I-864a except in special circumstances. For instance, if the couple is elderly and the spouse is entitled to the continuing pension income, the Consular officer would certainly be justified in asking for an I-864a. It's all subjective and circumstantial at that point. These kinds of things are not cut and dried.

Lately I have seen that more often they are requiring that the spouse of the co-sponsor fill out the 864A and attach their copy of past (assuming joint) tax return and proof of citizenship/LPR... Based on what the embassy told us at the interview last month, the CO stated that they have received recent guidance from the State Department to be extra diligent on the financial sponsorship of intending immigrants due to the economic situation...

Since most married couples just file using their joint tax returns, they want acknowledgement that the spouse is aware that they are sponsoring an intending immigrant.

Therefore, OP, just have the spouse fill out an 864A, submit the copy of tax returns and proof of residency and if possible a copy of past paystub/checks and you should be fine... Don't stress, just give em what they want and you should be fine...

Good info and does make sense as this economic situation is going to be with us for a while.
