I-130 package & Evidences of Bona fide Marriage

Having a Dam Hoi and Dam Cuoi that close together is odd. Many Vietnamese people have the Dam Hoi and Dam Cuoi on the same day, which is normal. Having it a week apart really sticks out.

My opinion about evidence of relationship or evidence of marriage is that the consulate officers have a job to do. If they were to pass people without having enough documents, then they personally could potentially get into professional or even legal trouble. Therefore, make their job easier and less stressful by giving enough documentation that makes your case at least passable.

In a nutshell they got into trouble when there were so many Fraud rings found to be successfully getting people through the HCMC office. With that said they know that if it happens again they will likely be out of a job. I understand that they want us to jump a higher hurdle, but at least they could tell us ahead of time what we need to be ready for...

For my case, we intended to have the wedding on 8/01/2009. We sent out wedding invitations and have restaurant and everything else set for this day. But the last minutes we did not get the marriage certificate as promised by agency. It was our stupidity to trust the agency. We are Catholic and the priest would not perform the wedding ceremony because we don't have the marriage certificate. We have to changed our wedding to an engagement ceremony. A couple of days later we got the marriage certificate. And then we have the wedding ceremony and another reception a week later.

Would this be a red flag? I could ommit the picutures of the engagement and only submit the wedding picutres. I currently have this information on my bonafide marital relationship document that I intend to send with the I-130 package.

Hi All,

We married on 08/08/2009 in Vietnam. I just got back to the States and fill out Form I-130 and supporting documents. I have all other supporting documents except for evidences of a bona fide marriage. Since we just got marry, we do not have any documents listed items "E thru I" from USCIS. Since we just got marry Vietnam, we don't have affidavits sworn by third parties in the US.

What other relevant documents that I could use to establish that there is an ongoing marital union?

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bona fide marriage. One or more of the following is acceptable documents:

E. Documentation showing joint ownership or property; or

F. A lease showing joint tenancy of a common residence; or

G. Documentation showing co-mingling of financial resources; or

H. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or

I. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or

J. Any other relevant documentation to establish that there is an ongoing marital union
