I sent all information for the filing of both the I-130 and the I129F to the attorney at the same time. When the NOA1 comes back from the I-130, the attorney will immediately file the I-129F.

I have been married/divorced previously and while I can perfectly understand why CSC needs a copy of the divorce decree, a copy of the marriage certificate from my first marriage baffles me. My attorney explained that they need proof that there was an actual marriage to be divorced from.

It's my understanding that the State of Nevada is not in the habit of divorcing people who were never married in the first place. Additionally, if for whatever reason, my first marriage was NOT valid, then that means I'm STILL not married and why should it matter in the processing of our case?

I offered to send a DNA sample and a copy of the findings from my last gynecological exam - it seems to me that they would be about as relevant as the certificate from my previous marriage. :jest:

Anyone else run into requests for strange information that seems to have no relevance to the case at hand?

Your attorney is right...the request is so that USCIS can verify that there was a valid marriage, and the divorce decree is so that they can verify that said marriage was terminated legally. Not everyone is married and divorced in the same state....or even in the same country. So that is why they ask for both. There will be times in the future, when a request from USCIS, or the consulate may not make sense and leave you scratching your head. There is an explanation behind each request....it may not be your logic, but it does make sense. Bottom line, you want your SO to get a visa....so if they tell you to jump, you ask how high and do it. :yes:

Wow, I missed something, I did not send in former marriage cert to hubby #1 AKA "Death wish marriage" only Divorce decree.

But we got approved , maybe I better pull old marriage license and take to hubbys interview? ! ? ! More ####### to dig out.

Yes, I did send the marriage certificate, after I ordered a copy of it from Clark County (I believe I burned, stomped on, buried and uttered an ancient voodoo curse over the original). I will send them whatever they want - I have a dentist appointment next week and will send them the x-rays if they wish. It just seems rather strange - I mean, the State of Nevada operates under the marriage guidelines set forth by the United States, last I checked... :mellow:

Hi...we just got her K-1 visa approved....and when I send in the I-129...I only sent in certified copies of my 2 divorces.....I was never asked for a marriage certificate and never provided one. I went through the entire process without any further documents or corrections requested by USCIS or Embassy.

It can be frustrating and VJ is a great place to vent, but don't let trivial things get in the way of the BIG PICTURE - obtaining the visa and being together with your loved one.

In the midst of the process is not the time to facilitate change in the system. If that means digging out evidence of bad decisions/memories ( Sister Len's accidental spouse line is superb) to get on with the good times, so be it.

Aside - Pursue the CR1 and drop the K3. CR1 is a much better visa. Less paperwork (no AOS), fewer fees (no $1010 AOS fee), SO gets a green card after entering the US.

It can be frustrating and VJ is a great place to vent, but don't let trivial things get in the way of the BIG PICTURE - obtaining the visa and being together with your loved one.

In the midst of the process is not the time to facilitate change in the system. If that means digging out evidence of bad decisions/memories ( Sister Len's accidental spouse line is superb) to get on with the good times, so be it.

Please don't get me wrong - I REALLY do appreciate the CR-1 > K-3 advice, but since money and working aren't really an issue for us, we opted for the K-3 because if it gets him here even 24 hours sooner, then it's worth the extra fees in my mind.

Now, if it turns out that we could have gone the CR-1 route and it would have been faster/same time as K-3, I make a solemn vow that I will personally post a picture of myself kicking my own #######. :bonk:

If your SO doesn't need to begin working in the US right after entering then go for speed. What I've seen lately the approvals are very close in time. And doesn't everyone love to have choices!?!?

Should I PM you my address to send the "extra money" you have floating around? :whistle: Actually, send some of it to Sister Len for the Accidental Husband usage.
