Hi

I was just wndering can i recieve my EAD even if I got an RFE for my AOS?

Got Married: June 17, 2009
Applied for SSN Card: June 19, 2009
Received SSN Card: June 25, 2009
AOS Timeline[
Sent AOS Packet: July 8, 2009
NOAs for AP and EAD: July 23, 2009
NOA for AOS: July 27, 2009
Biometrics date for my K2: Aug 22, 2009
Biometrics for me: Aug 20, 2009
Notice date for biometrics: July 31 and Aug 4, 2009
RFE received and AOS resumed: Sept 3, 2009
AP and EAD approved: October 22, 2009 (MY BIRTHDAY!)
AP approval notice received in the mail: Oct 25, 2009
EAD approval notice mailed: Oct 28, 2009

An RFE on your AOS will result in processing being suspended on the EAD until the RFE is resolved - it is certainly possible that you would already have your EAD issued before they get to your AOS.

Any RFE you get will hold up your process until it is resolved. Once they are satisfied with what you've sent, processing will resume. Pretty much what Otto und Karin said. ;)

What about the AOS now, are they satisfied or not. It says they will respond within 60 days from receiving our response on the RFE.

As long as you send RFE and they get it, then your AOS will be processed quickly.

I got my interview notice in the mail - set for 17 November.

By resolved does that just mean a response or that it was satisfactory? If you look at our timeline, you'll see that we got an RFE, then got transferred to CSC, then got EAD, but are still waiting for AOS approval. Still a chance we can get denied, right? (RFE for medical exam, which he got in April in Guatemala for the K-1, and the instructions specifically say if on a K-1 visa and medical less than 1 year then you don't need a new one; all we did was go to a Civil Surgeon to get his vaccinations tranferred and sent that with a letter and a copy of their instructions for the RFE response). Just a little worried!
