I am a student applying for my parents, and i am having a lot of trouble finding someone to sponsor them. They have been working steadily for over 10 years in the united states, paying taxes all the time. Would i be able to count their quarters on the I864, or would their illegal status preclude that?

Prob on a ITIN number, remember the government really doesn't discriminate againts illegal immigrants when it comes to get money out of them

for valid working "quarter" credits, it needs to be reported to the SSA.... reporting income to the IRS via an ITIN doesn't work....

Did your parents have social security taxes deducted from their paychecks while they were working without authorization? If so, then they might have met the 40-quarter requirement. Take a look at the exemption form.

my parents don't have an itin number but a ssn number that was issued to them when they arrived. Also, while they have been working there has been ss deductions on all paychecks. does that mean i'll be able to use the exemption form for them?

SSA doesn't usually issue a social security number to illegal aliens.

It sounds like they may have arrived legally (e.g. on a work visa like H1-B ), were issued genuine SSNs, and then overstayed while continuing to file using the SSNs assigned to them.

It sounds like they may have arrived legally (e.g. on a work visa like H1-B ), were issued genuine SSNs, and then overstayed while continuing to file using the SSNs assigned to them.

Until just the past few years, anyone could have an SSN; they are 'just' for reporting taxes (yeah right). Many people who were just visitors to the US got one, for banking etc.

Someone who has been in the US for 10 years, even illegally, could have a valid SSN.

The I-864 now requires that intending immigrant income be legally earned only to be included, so your parents' current income can not be used toward their support. I don't know the answer, but it would be very interesting to know if they qualify for I-864W if they have a valid Social Security statement showing that they have sufficient quarters credited.

You have earned (or can be credited with) 40 quarters of coverage under the Social Security Act (SSA). If you have 40 quarters or SSA coverage, you are exempt from the requirement to file Form I-864. You can acquire 40 qualifying quarters in the following ways:

By being credited under section 213(a)(3)(B) of the Immigration and Nationality Act with quarters worked by your spouse during the marriage or a parent during the time you were under 18 years of age; or

Working in the United States for 40 quarters in which you received the minimum income established by the Social Security Administration; or

A combination of the above.
