Hey,

Bad luck I had to find the jerk of all jerks. All the visa processing was going ok and all of the sudden he flipped out, turned out to be a real piece of work!!! How can I do to withdraw his pettition and maybe take legal actions on emotional and physcological abuse.

Anyways, if you could please help me, and if I meet someone else, am I banned to go because of what this sensless man did to me?

Im desperate, please help me!!! Does he go unpunished and can do this to some other woman? I do not think all this is fair!!!

Sorry for your troubles. Really. It could be stress, or maybe his true colors showing. You want to see all these things now, and not wait until you are in a marriage. Take a good long look at what happened and I hope you can move forward.... (((hugs)))

You can't withdraw the petition, but you can decline to apply for the visa once it gets to the consulate stage. If you don't respond, the approved petition will expire, and that's the end. As the beneficiary, there isn't anything you can do. If you want, when the embassy contacts you to invite you to apply, you can write back and say you aren't going to.

As for the rest, just leave him alone to live his life, and you live yours. It's too bad things didn't work out, but trying to get revenge isn't going to fix anything, and just makes you sound bad.

Agreed. I don't think she has any chance of taking any legal actions against him based on what she said, but she didn't say much. What exactly did he do to you? Did he say really mean things to you, cheat on your, threaten you? Or, did he do something else? (I don't know what...but there surely are *some* things he could have done that she actually does have a case against him!). I agree that she should just let him live his life and get over it. I'm sorry that you have had a bad experience, but unless he actually broke some sort of crime there is nothing that you can (or should!) do.

As other said, you cannot cancel your own petition. He can cancel it for you though, or you can just not show up at the interview. If you want it to be canceled faster as opposed to waiting for it to expire- he has to write a letter saying it is canceled. But unless you plan on meeting someone new and having them file you within the next 4-6 months, then it really makes no difference whatsoever.

If you do meet someone and they want to file you in the future, just be prepared to answers a lot of questions about why you have met another American and why the first relationship didn't work out.

Where are you in the process? Has your I-129 been approved? Have you applied for the visa? Medical, interview?

If you still haven't applied for the visa, you can just not do that and the petition approval expires and 'no harm done'. But, if you've already applied for the visa, and perhaps even been approved, you can just contact the consulate and give up your visa. You do not want to use the visa, if this is not the man for you, since you can only successfully adjust status from a K-1 if you marry the original petitioner.

As far as any legal action against him for psychological abuse....what exactly are you envisioning? What court of law do you think to pursue legal action in? Or better said, what laws do you think he actually broke?

I don't know the details of your situation...but I'm hard pressed to believe that there are actual laws this man has broken.

Take care of disassociating yourself from the K-1 petition/visa and leave it at that. Let karma take care of the rest.

Hmm is there much point in suggesting that the original poster is to blame for this situation?

If it boils down to lack of "facts" that seem to justify a rant at this person then perhaps you might want to consider that we cannot verify much of what anyone says on this site regarding their situations.

Anyway, sorry to hear about your situation and even though it's been very distressing for you as another member said - it's better to find out now (although that's small comfort).. don't waste time trying to get revenge - just learn from this unfortunate episode.. from what little you told us about it.
