hello how can i apply for the CSPA? is there any documents that we should file for CSPA? my Visa bulletin i think will be available by August of 2009. am i eligible for CSPA? my father is An LPR.. thakn you

You need to give us a lot more information if you want help. You cannot give no information about yourself and then ask if CSPA applies to you.

Date Immigrant Petition Filed = date the I-130 was received by USCIS

Date Immigrant Petition Approved = date USCIS approved your application and sent it to the National Visa Center (NVC)

Date Immigrant Petition Became Current = 1st day of the month when the visa bulletin tells you your PD is current (i.e., PD becomes current in Aug. 2009 visa bulletin, then date the immigrant petition becomes current is Aug. 1, 2009)

Is one parent (Step parent) US citizen, was marriage to your father before your 18th birthday? If so you step parent files I-130, this gets unlimited class visa, and MUST be issued before your 21st birthday.

If both parents are LPR or if you parents married after your 18th birth day, then your father (LPR) needs to file the I-130, however this falls into a lower limited class priority, which takes YEARS to process.

You asked this question back in Feb of this year and got pretty good answers. Are you looking for a different answer to the same question? Aaron very graciously answered again for you to see if you qualify. It is a pretty touchy subject but it is the law.

Applied 5/2007 Approved GC in Hand 10/2007
I-751 mailed 6/30/09 aapproved 11/7/09 The BOYS I-751 Mailed 12/29/09 3/23/10 Email approval for 17 CR 3/27/10
4/14/10 Email approval for 13 yr Old CR 4/23/10

Oldest son now 21 I-130 filed by LPR dad ( as per NVC CSPA is applying here )
I-130 approved 2/24
Priority date 12/6/2007
4/6/2010 letter from NVC arrives to son dated 3/4/2010
5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png
