Does K3 have to be activated right away?

My husband got his K3 on June 4 and cannot travel til end of December. I thought I had read that it had to be activated within 6 months.

He wrote to the embassy and they said it can be used anytime in the 2 years it is good for. Any thoughts?

Every type of immigrant visa has 6 months to be activated. Past that time it's void and you need to get a new one.

Once K-3 visa is activated, it serves as a multiple entry visa and is good for 2 years.

To the OP, sorry for giving wrong info - I was under the impression that K-3 goes the same way as K-1, CR/IR1 which have 6 months to be activated. My mistake.

I can't find anything in writing that it has to be activated within 6 months ...so I guess we will roll with him coming at the end of December.

If anyone else sees something on the activation of of a k3 to the contrary, let me know.

How about contacting NVC and see about processing the I-130 through to a CR-1 IMMIGRANT visa? More than likely you can get this through before you come to the USA in December.

This will save you $$$ and time when dealing with adjustment of status.

CR-1 IS work authorized, K-3 IS NOT, CR-1 can get a SSN K-3 CANNOT until they have adjusted status (MONTHS) or have EAD (MONTHS).

This will save you $700 or so from having to NOT file an I-485 to adjust status.

It is my understanding that you have 6 months from the date of issue to come to a US POE and be given the i-94 ("activating" the visa). After that, the I-94 and K3 visa are good for 2 years. I wouldn't take anyone's word for it on VJ. If you have reason to believe that the information is incorrect, I would contact NVC, USCIS and/or customs and border patrol.

He already interviewed and got the K3~ would he have to interview again if I finished out NVC at this late stage?

Yes, he would but then there would be no $1010 AOS fee and no joint interview to adjust status after he arrived. Also, no minimum of three months waiting for work authorization after entry. K3 is obsolete for most purposes but when it's in the passport it is definitely good for two years. If he wants, he can enter the day before two years is up. Then his I-94 is good for another two years.

People who are assuming K3 is the same as other visas are just wrong. The horses mouth gave you the right answer to begin with. Believe it.

Wow, thanks for posting this question Jackie, because I just found out something I didn't know concerning the validity time of the K3. I thought they were all good for 24 months (and I too thought it had to be activated in 6 months)...HOWEVER, I followed that link for the reciprocity schedule and for Iran it is only 6 months!!! If this is true and his K3 will expire after 6 months (and is that even long enough to get his AOS completed???), then this screws up a lot of plans we had. UGHHHH.... Has anyone else from Iran entered on a K3 and can tell me if this is so?
