Tax issues & the K-1

Hi all, I used the search function but came up empty on my question. I am interested in using a K-1 visa for my filipina fiance, but i am in arrears with the IRS as i have not filed in a couple years, (long story).

I am currently in the process of having this situation taken care of, but it's going to take quite awhile. My question is, is this going to deny the K-1? I have been employed for almost 20 years, of which the last 2.5 have been with a good company as a self-employed contractor. Annually I make considerably more than is required for the K-1. I have no bank accounts, but i have every pay stub since 2006. I know i got myself into this problem, but I really hope there is another option that will speed this process up. Any suggestions/experience/advice is greatly appreciated. Thanks.

Because you are self employed, you'll need at least the latest and preferrably the last three tax returns by the time the visa interview occurs. However, whether you've paid the IRS or not is not an issue.

Read, read, read here on VJ. You will find a lot of experience. Also, read the guides here to see all the questions and supporting evidence you will need to answer and/or show.

You've got to prove that you can support your fiance. So read through the affidavit of support and decide what you have that will satisfy that requirement. Sounds like your situation is not the norm. Take your time and read everything that you can. Might be worth finding an immigration attorney for some advice.

can't you just pay the fines and get the required tax returns?

Nothing is stopping him from filing tax returns or getting transcripts of old ones. Neither requires paying any back taxes or fines. You can file a return without paying the associated tax as well.
