I'm currently in the US on a 90-day tourist's visa, visiting my boyfriend. He's been working hard full-time since we filed our K1 packet, however the work is very difficult on him and he wants to switch to part time while I'm here so that we can spend an extra day together during the week. Both of us are very minimalistic, could get by on part-time pay and have a sponsor ready (his mother, who is a Lab technician) But we're both wary that pay-check stubs of a lesser amount might make my K1 interview/the process in general more difficult. He already has a lot of full-time pay stubs saved.

Has anybody successfully filed a K1 visa on a part time job? We really don't want to endanger anything with our case, and as insignficant as it may sound, the extra day together would really benefit both of us, as life situations are being very difficult at the moment.

He can always include a notarized letter with the I-134 that explains why he reduced his work hours. From talking to a visa specialist on the visa information line, a letter in clear English briefly outlining any unusual financial situation is always a good idea. It's a good opportunity for him to make a case that you won't become a public charge, too. If there's any doubt, he should include every scrap of evidence possible. We went so far as sending college transcripts, a copy of his cumulative SS earnings statement, proof of his VA education benefits, etc. I don't know what London's policy is, but technically there is no co-sponsor for the I-134. It never hurts to have that envelope from his mother at the interview, though. My husband sent one, and on it he put "I fully expect that my son will be able to adequately provide for________, his wife, but I am able and willing step in if assistance is needed."

Switching to part-time shouldn't be a problem as long as you have a co-sponsor that meets the poverty requirements. Best of luck to you two :)

It's not about a part-time job vs a full time job, it's about how much money he makes. They don't look at how many hours a week you work, or why you went from full time to part time. Including the last six months of his pay stubs, previous tax returns will help determine if he makes more than the poverty line. If not, as you said, you have a co-sponsor, so maybe it won't make a difference anyway.

I am self-employed..sometimes part time..sometimes full time. All depends on what I want to work. I'm well over the income guidelines but the NZ Consulate cared very little about this. Some people have stated the same with regards to London (if that's where you're going)... but the CO's in London dont seem to be on the same page with their 'rules' so who knows.

If he doesn't meet the requirements with his part time job then just have the co-sponsor. The full time pay stubs wont really matter so much if the employer letter states he's part time now.

The I-134 has no real 'rules'... most Consulates use the standards I-864 because you have to file for this at adjustment.

I agree with Thai family... just include a note stating why he switched.
