Hi! I am eligible to fill my N400 next month. My question is,we will be moving from MD to MO by the end of the year. Should I just wait till we move before I file or should I just file it next month ? My worries are,it could get lost by changing my address or it will slow down the process? Please help!!!!

Research the "Time in USCIS District or State" requirement for naturalization.

I know that, on the day you apply, you generally must have lived in the same USCIS district or state for the past 3 months. This means that if you move, you can't apply until you've lived at your new place for at least 3 months.

What I'm not sure of is whether this requirement causes problems if you move between filing and your interview, or between your interview and oath. Many of the naturalization requirements must be met at three times: on the filing date, on the interview date, and on the oath date. Offhand, I'd guess the "time in district or state" requirement must be met at all three times, but I'm not sure, and I didn't find an authoritative answer in my really quick web search I just did.

So if you're contemplating filing and then moving halfway across the country before your oath, you'll want to be sure that's OK.

Were it me, I would avoid changing my address with an application pending, if at all possible. In your case, I would wait until after moving. Or, alternatively, get a post office box where you are moving NOW, and use that PO Box as your address when you file the app.

PEOPLE: READ THE APPLICATION FORM INSTRUCTIONS!!!! They have a lot of good information in them! Most of the questions I see on VJ are clearly addressed by the form instructions. Give them a read!! If you are unable to understand the form instructions, I highly recommend hiring someone who does to help you with the process. Our process, from K-1 to Citizenship and U.S. Passport is completed. Good luck with your process.

If you don't have any urgent need to have US citizenship, I would recommend to wait for your move, and then wait for 90 days after relocating new home, then file N400.

If you move during the N400 process, you may cause communication problems between two district office, delay because of that, and/or rejected.

Instead of making complex case for USCIS people, you better make it simple for them.

Any way it will be delayed from USCIS because of address change, so why not waiting for your move done, and file for N400 in more simple way?

In theory, if your MD USCIS district office can not process your case by the end of this year when you move out, they have to transfer your case to MO USCIS district office because they have no jurisdiction for people who live in MO.

That means either MO district office should reject your case because you can not meet 90 days residency requirement, or postpone your case for 90 days so when they invite you for interview, you will be safe for that requirement.

But in the meantime, when they transfer the case between district offices, there may be a lot of possibility for mis-location including getting lost in the middle, and additional delay.

So if I were you, I will focus on move itself, and then when I settle on new place, I will wait for 90 days, then send N400 application form to USCIS with appropriate service center, who has jurisdiction for MO.

USCIS have changed the address where people should send N400.It's not in the service centers anymore. It's in Phoenix. I want to file my N400 because I want to petition my mom as soon as I become a citizen.so,yeah that's why I wanted to file it next month. But I am still thinking twice about it.

Normally if you move to a new state that has different service center then you will have to wait 3 month before you could apply. For example, if I moved from Florida to TX, I do not have to worry about the 3 month in TX since the service center is TX, but if I moved from Florida to CA then I have to wait 3 months before filling since the two stats have different service center. This may change with the new filling that starts 10/14/2008.

I have a friend who moved from Colardo to florida and applied for citizen after 2 months . USCIS did not reject his case. When he showed up in the interview the USCIS officer deined his application becasue he did not wait for 3 months. He applied from scratch and had to pay the pplication fee again.

Don't think USCIS will think as your way.

When you deal with USCIS, you have to think as their logic.

They have a lot of files waiting for processing.

From what people is telling and my experience, interview officer doesn't look at this file until you meet them in person for most cases.

If they marked for later review, it can easily drag for another year.

So normally when interview officer found that you couldn't meet the residency requirement, they will just deny the case.

It's up to you to follow the rule to make their life easier.

For same logic, when USCIS service center receive your application, they don't look at other things.

They just enter the info into system, then generate fingerprint notice and interview notice per your address in N400 form you submitted.

So probably unless you follow up with new address ASAP, they may schedule fingerprint and interview from old address when you move.

If you ask for rescheduling and address change, it may easily drag another couple of months.
