VERMONT DECEMBER FILER, TOUCHED 2008/FEB/24, EXPEDITE, RFE!

I am very dissapointed and sad because I can't understand why I have to suffer so much in order to live with my husband.

My husband filed my I-130 in December, our NOA1 was on Feb 5, 2008. 45... days to open an envelope! Unbeleivable!

Our first touch was on Feb 24, 2008. I know that there are a lot of people who were touched on this day!!.

I see in this forum a lot of people in the same situation as us.

We were very patient until June! In June I felt very frustrated and my husband called USCIS for the first time to complain (6 months since he had filed the I-130).

The lady on the phone suggested to file an I-129F and he did it because the most important thing was for us to be together.

I found this forum in June and I learned a lot of information.

In June my husband also contacted a congressman (state senator) but the congressman did not help us: USCIS responded to them the same way "we are working on July 07 forms".

Before reading the forum, we had not heard of Expedite Requests. I wasn't sure we could do it but my husband called USCIS again and asked for an Expedite request (medical reason). They asked for the documentation for my reasons and they started to touch our case. I was very happy to see changes in the updated dates on their webpage.They approved the Expedite!!!

Woww! We were very happy because I have a lot of problems and being without my husband drives me crazy.

I always thought that something happened to the filers that have a Feb 24 2008 Touch.

I read somewhere in this forum that maybe they moved the forms and lost it and the forms are sitting on someone's desk or in a big mess!

OK!! On July 24 2008, I saw an RFE on the web!!!! Something was very suspicious because my husband is very careful and picky. My husband called the congressman, he called USCIS, and he told my husband that our petition was a copy and not the original and that they needed the original with signatures.

I don't know whether to cry or to laugh because he would never send USCIS a copy. He has the copies of our package at home.

They need a new form with an original signature not a copy! Haaaaaaaa, Haaaaaaa,Haaaaaaaaa (Sarcasm)

Now I am sure they lost our form and now they need one with a signature because they do not have it.

I am happy because I know that they are working our case and I know that the approval is coming soon. But I feel very very dissapointed with USCIS because they do not do a good job!!

I have a very good reason for an expedite but I feel bad because I would have prefered not to be forced into asking for one.

The only thing I would have liked was to see Vermont process petitions in order and FIFO.

First In First Out!!! It is very simple with a little order.

In our case my husband sought help with the congressman for my daughter's petition since I already am granted a CR1 visa last May 23 so to hasten the process he sought help. His grounds to expedite are HUMANITARIAN REASON since my daughter is a minor and she is solely dependent on me and USCIS ERROR because USCIS agents gave us wrong information about the I-130 process thus delaying the petition of my daughter. The congressman's office is helping us now and is successful. Presently, our documents are assigned to a certain supervisor in NVC. I remember my daughter's case was approved only a day (17 hrs to be exact) after we sought the help of the congressman. Now we are just waiting for the completion of her case. My daughter doesn't need to have an interview because I brought her with me during my interview as per instruction by the congressman's office. Currently, we are at the NVC stage so things will be a lot quicker now.

But overall for the expedite to be successful, the immigration specialist in the congressman's office should be proactive and efficient to be able to keep things moving. We are blessed to have gotten one. If we had gotten a lazy careless person I'm sure things would have been sluggish. Hope this helps.

my husbands congressman also contacted uscis and all we got was that they were processing cases saccording to how they receieve them. FIFO . now what is all this FIFO thing about? i mean, there have been cases approved which were filed later than ours so it cant be FIFO.

oct. 23,2008 ---- RFE

nov. 3,2008 ----- case complete

We too receive a RFE after approval of an expedite request. Not knowing what exactly they requested or what went wrong was really nerve wrecking for me. So, I could understand the anxious feeling you might feel while waiting for the RFE hardcopy to arrive. We got an RFE for the marriage certificate in original language, which my husband claimed he did mail it with the package. Anyway, he replied to the RFE and mailed another one.

For our case, the RFE took about 10 days to arrive and it took another week to get into the system. But, our case was approved right after the RFE got entered into the system. If that helps to make you feel better that there's light at the end of the tunnel. :-)

Have the congress aide keep following up on your case, so they will not sit on your case but work on an approval as soon as you return the RFE.

Hi!!!

Finally, my Husband received the RFE Hardcopy, yesterday!!! (2008/07/31)

Unbelievable but True, The only thing that they need is a new form!!! I am sure, they lost our original form!!!! GRRRRRRR!!!!!

Sasha, thank you for sharing your experience!!! FIFO do not exist in Vermont, I do not know in California,but in Vermont there is not FIFO!!

I am waiting more than 7 months, 7 months is too much!!!! And the process is not completed!!!!

The whole process makes me feel very sad!!

Our RFE hardcopy took 7 days! Now, My husband is in Chigago (Business trip), and he do not know if he could go to the mail office today! He is going to send all the documentation, not only the form!!!

He do not want more surprises!

My medical condition got worse during this process!! I do not like to use the expedite request, but now I feel very bad, and I need my husband around me!

We do not want to see again a RFE!!!!

VSC is going to have our documentation this Monday!!!

For our case, once they receive the RFE, it took about a week for the online system to change status to "RFE received and processing resume". The I-130 was approved right after the RFE entered into the system. But, we did not know because we didn't receive any email notice, no change in the online status too. I got anxious and called the congress aide to follow up. He found out our case was approved two days ago. The hardcopy NOA2 arrived 8 days later.

I am positive you will be getting an approval in 1-2 weeks after turning in the RFE. Hang in there..

I am positiveee!!! I am going to have my approval in 2 weeksss!!!!! (If I say too many times, maybe it is going to be a reality!!!! hahahaha)

My wedding anniversary is in September, The Visa could be the best present for my husband and me!!!

NVC and Embassy process is going to take more or less 2 months, I guess!!!!

My case (an expedited one), the "RFE received and processing resume" status was shown after 2 days they got the evidence via post mail. The case was touched 3 consecutive days after that. Till now, 10 days has been passed since the last touch, I have not heard anything (no status change online, no email, no mail). I don't know how long I have to wait.
