questions about my k-1 visa...

K-1 VISA

hi my name is ben i live in the u.k and have been engaged to my fiancee for about a year now. (shes american)

im due to be called for an interview nxt month at the u.s embassy in london but have a few questions to ask and if anyone could help me i would be very grateful..

1. ive got a caution on my police record for carrying dope but got let off, this happened about 6 years ago just wondering whether this might hurt my chances of getting accepted??

2. i currently dont have a job lined up out there but have around £11,000 in my bank will that be enough money so they dont think i will become a public charge?? (does anybody know how much is acceptable??)

3. for my interview they only documents i have to prove we are engaged/couple is: international phone cards,photos,letters,letters from friends and family saying we are intending on getting married etc, phone bill, bridal shower invertations etc. will this be enough?

4. on the form I-797 notice of action, petition for fiancee it says valid from 03/26/08 - 07/26/08. does anybody know what this date is for?? my fiance phoned up the office in vermont and they said i have to be on american soil by that date. i rang the embassy and they said it doesnt mean that and i shouldnt worry!! im sooo confused!!

if anybody can advise me in anyway i would be so happy.. thanks for your time :wacko:

1 dont know how the counselor officer will handle that they may require a waiver.

2) US citizen who filed the I-129F petition is the one needing a job or assets in the USA to provide sponsorship or will need to get a co-sponsor, NOTE £11,000 is not enough, the ammount in assets need to be 3 times 125% povertyline. http://www.uscis.gov/files/form/I-864P.pdf

3) Good, as well as a renewed letter of intent.

4) It is the period of validity of the I-129F petition, the embassy or consulate tend to extend this if they cannot interview withing that period.

For point 2, as YuAndDan said, it's the petitioner (US citizen, i.e. your fiancée) who should provide the support. I read somewhere on VJ documents that assets of the beneficiary (i.e. you) can help if they are readily "convertable to cash". in all cases, you should rely on either your fiancée as your sponsor, or someone she knowns, anyone i mean, in the u.s. ready to "co-sponsor".

Yes London does allow the beneficiary to use their funds but need to show how the funds will be transfered.

As long as the spouse earns above the 125% which for a family of 2 is $17,500 annually you don't need to have any other saving or assets do you? My fiance earns above the poverty line but rents and has a loan on his car and a student loan do they look at the loans or just the income?

All they are concerned with is Gross INCOME before taxes and deductions, the don't care about expenses.

Facts are cheap...knowing how to use them is precious...

A caution in the UK is not a 'warning'. In order to be given a caution one has to admit guilt. Saying that he has no convictions could come back to bite him on the behind. He also says that it's on his police record so it's there in black and white for the ConOff to see.
